226 Deputy Sandra McLellan asked the Minister for Social Protection if a person (details supplied) in County Cork who was refused disability allowance will be put back on domiciliary allowance in view of the new conditions announced in budget 2012; and if she will make a statement on the matter. As a result of the decision to withdraw section 8, 9 and 10 of the Social Welfare Bill 2011, the age limit for receipt of domiciliary care allowance (DCA) remains at 16 years. As the child referred to is over 16 years of age, DCA is no longer payable.

The person concerned has not made an application to pay their rent supplement directly to their landlord. If an application is made to the Department's local representative administering the supplementary welfare allowance scheme this request will be considered.

The Budget 2012 proposals relating to the conditions and rates of payment for Disability Allowance and Domiciliary Care Allowance are not being introduced as planned pending a review which will be undertaken by Ms. Ita Mangan, Chair of the Advisory Group on Tax and Social Welfare.
