The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 25 January 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. When received, the appeal in question will be referred in due course to an Appeals Officer for consideration.
The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Ceist:342 Deputy Gerald Nash asked the Minister for Social Protection when an appeals process involving the SCOPE section of her Department and relating to the following companies and persons (details supplied) will conclude; and when the decision relating to that process will be made available to those who are directly involved. Amharc ar fhreagraI am advised by the Social Welfare Appeals Office that an oral hearing of the appeal of the person concerned took place on 12 May 2011 and the Appeals Officer is now considering the appeal in the light of all the evidence submitted, including that adduced at the hearing. The Appeals Officer is also researching certain aspects of the case and hopes to have this research completed shortly and a decision issued by the end of next month. The person concerned will be notified of the Appeals Officer decision when the appeal has been determined.
