266 Deputy Brendan Smith asked the Minister for Social Protection when a domiciliary care allowance application will be approved in respect of a person (details supplied) in County Cavan; and if she will make a statement on the matter. [13753/12]
Amharc ar fhreagraThe Social Welfare Appeals Office has advised me that an appeal by the person concerned was referred to an Appeals Officer for consideration. However, before consideration of the case, additional medical evidence was received which the Appeals Officer has forwarded to the Chief Medical Advisor for his comments. On receipt of his response the appeal will be referred back to the Appeals Officer for further consideration.
The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Amharc ar fhreagraI am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all the available evidence, including that adduced at oral hearing, allowed the appeal of the person concerned. The person concerned was notified of the Appeals Officer decision on 7th March 2012.
