380 Deputy Brendan Griffin asked the Minister for Social Protection if a decision has been made on the appeal for the back to education allowance in respect of a person (details supplied) in County Cork; and if she will make a statement on the matter. [25230/12]
Amharc ar fhreagraI am advised by the Social Welfare Appeals Office that the Back to Education Allowance is not appellable to that Office. Following enquiry from the Social Welfare Appeals Office to the Deputy, I am advised that the question was intended to be in relation to a Jobseekers Allowance appeal by the person concerned which was registered on 29 October 2011. In relation to this appeal, I am advised that this case has been referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
