198. Deputy Tom Hayes asked the Minister for Agriculture; Food and the Marine if a review was requested in respect of a single farm penalty appeal on behalf of a person (details supplied) in County Tipperary; and if so, the outcome of this review; and if he will make a statement on the matter. The person named requested a review of a decision to impose a 3% penalty arising from a contravention of the Nitrates Regulations. The outcome of the review was to uphold the original decision which was notified to the person concerned on 8 February 2012. The person was also informed of the right to appeal the outcome of the review to the Independent Agriculture Appeals Office within 3 months of the date of the review. My Department understands that an appeal has not been received by the Agriculture Appeals Office.

If the Director of Appeals considers that there are exceptional circumstances, a late appeal may be accepted for consideration. Accordingly, if the person concerned wishes to pursue this avenue, an application should be made to the Director of Appeals, Agriculture Appeals Office, Kilminchy Court, Portlaoise, (www.agriappeals.gov.ie ) outlining the circumstances and enclosing all relevant documentation. The outcome of this process can be appealed to the Office of the Ombudsman.
