Departmental Expenditure

251. Deputy James Bannon asked the Minister for Education and Skills the cost in 2011 to his Department and to each body under the aegis of his Department of implementing the Official Languages Act 2003; and if he will make a statement on the matter. [44464/12]

The costs incurred by my Department in relation to implementing the Official Languages Act 2003 in 2011 are in respect of the translation of documents and the provision of Irish language training to staff. Translation costs €145,004.16; Irish Language Training €13,453.10. There may be additional costs that have been incurred by various sections of my Department with regard to implementing the provisions of the Act. These costs have been from within existing allocations and are not readily identifiable. With regard to the bodies under the aegis of my Department, the expenditure incurred in respect of the implementation of the Official Languages Act 2003 is an administrative matter for each agency.

Schools Building Projects Status

As the Deputy will be aware, my priority is to ensure that there is sufficient school accommodation to meet projected pupil enrolment increases into the future. The 5 Year Construction Plan that I announced on 9 March last as part of a €2 billion capital investment programme outlines the major school projects that will commence construction over the duration of the Plan.

In addition to the Five Year Construction Plan my Department is committed to publishing a detailed annual programme in relation to planned expenditure on individual major school projects commencing construction. The first of these, which related to 2012 expenditure, was published in December 2011 last. It is anticipated that details of the 2013 annual programme will be announced before year-end. Meanwhile, the current status of all projects on the school building programme may be viewed on my Department's website at www.education.ie and this will be updated regularly throughout the year.

Third Level Fees

The position is that persons who hold subsidiary protection in the state will meet the nationality clause of my Department's free fees schemes. I understand that officials of my Department have been in contact, via the Higher Education Authority, with the third level institution concerned and have clarified the position in relation to the nationality clause of the free fees scheme, in respect of the student referred to by the Deputy.

Fáilte Ireland operate the Ireland Scholarship Programme in a number of priority markets, with funding from my Department, as recommended in the International Education Strategy 2010-2015. This programme is aimed at English language teachers and provides recipients with a period of study in Ireland. The intention is that these language educators will become advocates for an English language education in Ireland in promotional campaigns in their home country. In 2011/12, scholarships were awarded to language educators in the priority markets of Japan, Korea and Turkey. Information on the programme is available on www.irelandscholarship.com.

It is not envisaged that a Minor Works Grant will be issued to the school in question or indeed to any primary school for the school year 2012/2013. At the launch of the Government's Medium Term Infrastructure and Capital Investment Framework last November, I said that the priority in the education sector is to focus on major school projects and smaller projects devolved to schools to meet demographic demands over the next five years. I indicated that given the need to concentrate on meeting the need for additional school places that it is unlikely that funding would be available for a minor works grant in the coming years.

I do not intend to give any specific commitment on future budgetary decisions. This is a matter that I will have to consider with my colleagues in Cabinet in the context of the next budget and meeting our obligations under the EU/IMF Programme. The government will of course try to ensure all budget decisions are as fair and equitable as possible but I cannot give specific commitments in relation to the matters raised by the Deputy.

School Staffing

The redeployment arrangements at primary level include provision for the appointment of a panel officer to deal with any difficulties in relation to the operation of redeployment panels. These arrangements were formally agreed centrally with the education partners (school management bodies and the INTO) in January 2009. Under these arrangements the decision of the panel officer is binding on all parties. A Panel Officer was appointed on 20 September to adjudicate on the filling of a vacancy in the school referred to by the Deputy by a teacher on the subsidiary special national panel. The Panel Officer, having consulted with all the relevant stake-holders made his decision available to the Patron, the Board of Management of the school and my Department on 12 October, 2012. It is now a matter for the school concerned to fill the vacancy in accordance with the Panel Officer's decision.

Third Level Fees

Under the terms of my Department's Free Fee Schemes the Exchequer meets the cost of tuition fees in respect of eligible students who are pursuing full-time undergraduate courses of study which are a minimum of two years duration in an approved higher education institution. The main conditions of the scheme are that students must be first-time undergraduates, hold inter alia EU/EEA/Swiss nationality in their own right, and have been ordinarily resident in an EU/EEA/Swiss state for at least three of the five years preceding their entry to an approved third level course.

Currently there are exemptions to the residency clause of the scheme for persons posted abroad in the service of the state and for volunteer development workers. These exemptions are currently being examined and decisions in this regard will be made when these deliberations are completed. I would point out that the higher education institutions are autonomous bodies and the criteria governing the level of tuition fees to be charged (EU or Non EU rate), in cases where undergraduate students do not qualify for free fees and in the case of postgraduate study, is a matter for the institutions to determine.

The acquisition process for the securing of a site for the school, referred to by the Deputy, is currently in train. In view of the need to prioritise available funding for the provision of additional school accommodation, the delivery of major school projects required to meet future demographic demand will be the main focus for capital investment in the coming years. In light of current competing demands on the Department's capital budget, it is not possible at this time to indicate when a project for the school in question will be progressed.

My Department currently operates thirteen bank accounts with commercial banking organisations. These accounts are principally used to make payments by electronic funds transfer or to receive funds which are subsequently transferred to the Exchequer Supply Account held in the Central Bank. A detailed schedule listing the name and purpose of each of the accounts, as well as details relating to the percentages of payments which are issued electronically by my Department, is attached. In regard to the vast majority of the accounts that my Department operates, banking fees are not levied. In 2011 fees totalling €1,357 were incurred, while up to end September 2012, fees totalling €996 were incurred. No bank interest was paid by the Department in either 2011 or to 30 September 2012. Interest was also earned in respect of the National Training Fund and the Educational Endowments deposit bank accounts. Interest totalling €31,065 was earned in 2011 while €13,125 was earned to 30 September 2012. The bulk of the interest earned arose on the National Training Fund Account.

My Department also avails of a foreign payments service with Investec Bank for which fees are incorporated into the currency exchange rate supplied by this bank. The information requested by the Deputy with regard to agencies under my Department's aegis is not held centrally by my Department.

The decision on eligibility for new student grant applications from the 2012/13 academic year is a matter for the new centralised grant awarding authority, SUSI (Student Universal Support Ireland). Officials in my Department have confirmed with SUSI that documentation was requested from the student referred to by the Deputy. The documentation was received on the 26th September 2012 and is currently under consideration. When the analysis is complete the student will be notified directly of the outcome.

The Deputy will appreciate that in the absence of all of the relevant details that would be contained in an individual's application form and supporting documentation, it would not be possible for me to say whether or not a student should qualify for a maintenance grant.

21 staff from my Department availed of the Special Civil Service Incentive Career Break Scheme 2009 and this was counted as a reduction in my Department's staffing numbers during their career break. I understand that you clarified to my officials that you were looking for the full year cost and savings of the Scheme in respect of 2011. The 2011 cost of the Scheme for 19 staff members (2 out of the original 21 staff were not availing of the Scheme by 2011) was €205,688 and the 2011 savings on the pay bill was €548,469. The savings are based on salary plus employers PRSI savings less the incentive payments made to the relevant staff under the Scheme during 2011. The current estimated full year cost for the return of staff in 2013 is €554,792 including salary and employers PRSI, based on 13 staff who have not sought further extensions of their incentivised career breaks.

Public Sector Staff Career Breaks

The information requested by the Deputy is only readily available for teachers and special needs assistants employed in primary secondary and community/comprehensive schools. There are one thousand one hundred and eighty nine primary teachers, eighty three special needs assistants and three hundred and four teachers in secondary and community/comprehensive schools currently on career break. The period of absence on career break is a period of unpaid leave for the person availing of it. The teachers and special needs assistants employed as replacements are generally paid on a lower point of the incremental scale and accordingly there are no additional costs associated with the operation of this scheme. The operation of the scheme does not impact on overall numbers employed.

Circular 10/2011, which was issued in February 2011, introduced a revised Career Break scheme for registered teachers in recognised primary and post primary schools. It increased the maximum period of absence on career break in the course of a teacher's professional career from 5 to 10 years. It also discontinued a number of other forms of leave including study leave, diplomatic leave and Oireachtas leave."

Public Sector Reform Review

Deputy Gerry Adams asked the Minister for Public Expenditure and Reform further to his televised address to the nation on 4 December 2011 when he said this week's budget will go further, 50 quangos will be abolished or merged, and the public sector will be downsized by 23,000 persons by 2015, if he will set out in tabular form the names of the quangos that have since been abolished or merged and the date on which they were abolished or merged. As the Deputy will be aware the Public Service Reform Plan, published in November last year, covered a broad range of reform areas and demonstrated the Government’s commitment to reform and the pursuit of efficiencies in the delivery of Public Services. One of the programme of reforms decided on was to proceed with the rationalisation of 48 State Bodies by the end of 2012. Details of the bodies involved are set out in Appendix IIa of the Plan. While my Department is monitoring progress on the implementation of these measures on a quarterly basis, questions regarding the approach and progress of individual measures is a matter for each parent Department and should therefore be directed to the relevant Ministers.

In terms of agencies under the ambit of my own Department, the Government’s Public Service Reform Plan included the measure that the Commission on Public Service Appointments should be merged with the Office of the Ombudsman. This merger took place on an administrative basis with effect from 1 October 2011 and since then the necessary legislative measures to give full statutory effect to the merger have been progressed and are included in Sections 17 to 20 of the Ombudsman Amendment Bill, which is before the Seanad this week.

Multi-annual Budget Plans

The Programme for Government includes a commitment to developing multi-annual budget plans across a three-year time horizon. In keeping with this commitment, the Comprehensive Expenditure Report 2012-2014 introduced a range of budgetary reforms including a Medium Term Expenditure Framework (MTEF), published in December last year. The key features of the MTEF include multi-year aggregate expenditure ceilings along with Ministerial expenditure ceilings. The multi-annual dimension to the ceilings encourages a more focused approach to medium-term structural and strategic planning of expenditure within departments.

As a further incentive to encourage prudent and responsible management of expenditures within the allocated Ministerial ceilings, the MTEF includes a provision for Departments to carryover some portion of any unspent current expenditure allocation from one year to increase the expenditure ceiling for the next year. This feature will operate in a similar manner to the capital carryover facility which was introduced in 2004 as part of the multi-annual capital investment framework and has been operating successfully since its inception.

Initial expenditure ceilings were set out in the Comprehensive Expenditure Report 2012-2014 and currently form the basis of the Estimates 2013 discussions. The Ministers and Secretaries (Amendment) Bill 2012 aims to put these reforms on a permanent statutory basis by replacing the corresponding section of the Ministers and Secretaries (Amendment) Act 2011. This is also in keeping with EU/IMF Programme commitments to introduce fixed expenditure ceilings into law. This important innovation in Irish policy-making will put Ireland’s resource allocation and planning in line with best international practice and I look forward to discussing and debating the provisions of the Bill before the Oireachtas in the coming weeks. The full operational details of the MTEF, including the arrangements for current carryover, will be set out in a Circular from my Department, and initial consultations on the form of the draft Circular are already under way at official level.

Freedom of Information Fees

The Deputy may wish to note that the average search and retrieval charge in 2011 for a non-personal Freedom of Information request was €7.42, just over one third of the hourly rate of €20.95, a fee which has been unchanged since the introduction of the Freedom of Information Act 1997.

The Deputy may be aware that in the statement I issued on 11 July 2012 communicating the Government’s decision on the reform and extension of Freedom of Information, I announced that I had also asked my Department to undertake a focused review of the management of Freedom of Information requests by public bodies to determine what improvements in the working of the Act could be achieved and what steps may be necessary to seek to promote good practice in the use of the Act. This review will provide the opportunity to assess the effectiveness of the current regime for search and retrieval fees; taking into account, for example, the proposal included in the Private Member’s Bill on Freedom of Information on which the Second Stage debate in the Dáil took place on 6 July 2012.

The Department of Public Expenditure and Reform was set up in July 2011. In 2009, 2 members of staff, who were at that time Department of Finance employees and subsequently became employees of the Department of Public Expenditure and Reform in July 2011, availed of the special civil service incentivised career break Scheme. The staff were reflected as a reduction in our numbers. The cost to my Department was €25,000. The savings on the pay bill in that time period was €106,218. Only one of the officers returned from the incentivised career break and the full year salary cost in 2013 will be €48,831. No staff members applied for a further extension of their leave. In all cases, my Department fully complied with the terms and conditions set out in Circular 13-2009.

One of the Career Breaks (a 3-year incentivized Career Break) cost the Valuation Office 12,500 in 2011. The Government recently made a decision to revise the civil service career break scheme to allow participants take up alternative paid employment in Ireland. My Department is currently drafting this new circular.

The cost in 2011 to my Department of implementing the Official Languages Act 2003 was 4,870.98. With regard to the Offices and Agencies under the aegis of my Department the following is the position:

Ombudsman

The cost to the Office of the Ombudsman, Office of the Information Commissioner, Standards in Public Offices Commission and the Office of the Commissioner for Environmental Information of implementing the Official Languages Act 2003 in 2011 was approximately 12,129.27. The cost to the Commission for Public Service Appointments in 2011 was 6,080.00.

Public Appointments Service

The cost of implementing the Official Languages Act in the Public Appointments Service in 2011 was 131,863.

State Lab

In 2011 the cost associated with implementing the Official Languages Act 2003 in the State Laboratory was 631.75.

Special EU Programmes Body

The total cost to the Special EU Programmes Body in 2011 for the provision of Irish language services (translation) was 3,379.85.

Office of Public Works

The Office of Public Works (OPW) has advised me that it is not possible for them to provide the detailed information sought in the time available. A response will issue directly from the OPW to the Deputy in due course.
