I am not aware, at this time, of any meetings with NAMA and my Department, between St James's and NAMA or any other discussions that have taken place with respect to Mount Carmel Private Maternity Hospital.

The Working Group to Develop an Overdose Prevention Strategy presented its draft report to the HSE earlier this year. I understand that this report is being considered by the HSE and that a financial impact assessment of the implications of some of the recommendations is being carried out. It is anticipated that the draft report, with the views of the HSE in relation to the recommendations therein, will be communicated to me shortly. Publication of the report will be considered at that time.

Hospital Accommodation Provision

Durkan asked the Minister for Health the reason the Health Service Executive has reduced the patient complement at St Bridget’s Nursing Home, Crooksling, County Dublin, at a time when it was necessary to ensure the utilisation of the maximum accommodation for patients and given that previously the full complement of patients was deemed to be 120; if he accepts that intervention by the Health Information and Quality Authority resulting in reduction of patient accommodation undermines the efficiency of the hospital and the need to accommodate the maximum need of patients; if he will undertake to ensure that maximum accommodation for 120 patients is retained, the restoration of the ambulance service which has catered for this community based and community supported service including day care services at Crooksling; if he will as a matter of urgency examine the basis upon which it was determined to curtail the quality and scale of services in view of the ability and commitment of staff to accommodate any requirements; if he will accept that action by HIQA and the HSE has sought to undermine the viability and efficacy of services at the hospital; if he will take whatever steps necessary to address this issue; and if he will make a statement on the matter. This Government is committed to ensuring the health and safety of residents in nursing homes, whether they are private, voluntary or public. In order to ensure this, it is vital that we have effective mechanisms in place to maintain and enhance public confidence in the delivery of quality services. The Health Act, 2007 provides a regime designed to protect residents through an independent inspection and registration system. On 1 July 2009 Statutory responsibility was given to the Chief Inspector of Social Services, part of the Health Information and Quality Authority (HIQA) to carry out this function.

This responsibility is underpinned by a comprehensive regulatory framework and National Quality Standards for Residential Care Settings for Older People in Ireland. All nursing homes are subject to the same core standards and regulations in relation to quality and safety in order to ensure the well being of their residents. As the specific issues raised by the Deputy are service matters they have been referred to the Health Service Executive for direct reply.

Health Services Provision

The Clinical Care Programmes provide a national, strategic and co-ordinated approach to a wide range of clinical services. They have three main objectives – to improve the quality of care, to improve access and to improve cost-effectiveness. Their primary aim is to modernise the way hospital services are provided across a wide range of clinical areas. This is being done through standardising access to and delivery of high quality, safe and efficient hospital services, and maximising linkages to primary care and other community services. Currently there are 29 Clinical Care Programmes in different stages of development/implementation.

As part of the Orthopaedic Clinical Care Programme, prospective funding for total hip and knee replacements was introduced. Seven hospitals were initially selected and a price was agreed per procedure. This agreed price also takes account of other medical conditions which patients may have, that may impact on their length of stay. The reforms introduced have facilitated a reduction in the average length of stay (AvLOS) for total hip and knee replacements. The introduction of new care pathways identified a target AvLOS of 7 days for total hip and knee replacement and 10 days for revision hip replacement. As per the table below, the AvLOS for hip replacements is currently 6.7 days and for knee replacements is 6.6 days. These are below the target AvLOS of 7 days.

In 2012, it is projected that this will result in savings of approximately 5,200 bed days for total hip/total knee replacements.

The report of the National Substance Misuse Strategy Steering Group in relation to alcohol was launched in February last and it is continuing to encourage public debate. My Department is developing proposals on the basis of the recommendations of the Steering Group including those on advertising referred to by the Deputy. These were considered by the Cabinet Committee on Social Policy and are due to be submitted to Government for consideration and approval.

General Practitioner Services

Section 11 of the General Medical services (GMS) General Practitioner (GP) Capitation Contract, which was introduced in 1989, provides that the medical practitioner shall provide for eligible persons, on behalf of the Health service Executive, all proper and necessary treatment of a kind usually undertaken by a general practitioner and not requiring special skill or experience of a degree or kind which general practitioners cannot reasonably be expected to possess.

GPs who hold GMS contracts with the HSE must not seek or accept money from medical card or GP visit card holders for services covered under the GMS contract.

The GMS contract also stipulates that fees are not paid to GPs by the HSE in respect of certain medical certificates which may be required, for example, "under the Social Welfare Acts or for the purposes of insurance or assurance policies or for the issue of driving licences".

Consultation fees charged by general practitioners to private patients and to GMS patients outside the terms of the GMS contract are a matter of private contract between the clinicians and the patients. While the Minister for Health has no role in relation to such fees, it would be expected that clinicians would have regard to the overall economic situation in setting their fees.
