I am informed that the incident referred to by the Deputy was fully investigated at the time by members of An Garda Síochána and a file was prepared for the Director of Public Prosecutions (DPP) who directed a prosecution in the case. The case in question was heard before Cavan District Court on the 26th of February 2009 where applications to bind certain individuals to the peace were dismissed. As the Deputy is aware, the DPP and the Courts are independent in the execution of their functions. Accordingly, it would not be appropriate for me to comment on the matter.
