267. Deputy Bernard J. Durkan asked the Minister for Social Protection the position regarding an invalidity pension appeal in respect of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [55601/12]
Amharc ar fhreagraAn application for invalidity pension, by the person concerned, was disallowed by a Deciding Officer of the Department on 9th June 2012. I am informed by the Social Welfare Appeals Office that there is no trace of appeal against this decision by the person concerned. In the normal course, an appeal against the decision of a Deciding Officer must be made within 21 days of a decision being notified. Appeals received outside of this time limit may be accepted at the discretion of the Chief Appeals Officer. I am informed that the person is being written to by the Social Welfare Appeals Office inviting her to make application for a late appeal and to set out the reasons therefor. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
