Local Authority Funding

176. Deputy Róisín Shortall asked the Minister for the Environment, Community and Local Government further to Parliamentary Question No. 512 of 29 January 2013, when funding will be allocated to local authorities for the housing adaptation grant schemes for older persons and persons with a disability; the level of funding that will be allocated to each local authority and if he will ensure that funding levels for the previous year will be maintained; and if he will make a statement on the matter. Fire Stations Upgrade

Deputy Micheál Martin asked the Minister for the Environment, Community and Local Government if he will intervene in respect of the delay in finalising arrangements for major development works at the Fire Station on Belgard Road, Tallaght, Dublin 24, which was the subject of a previous grant aid announcement by his Department; if he will appreciate the urgent need for progress on this issue; and if he will make a statement on the matter. The provision of a fire service in its functional area, including the establishment and maintenance of a fire brigade, the assessment of fire cover needs, the provision of a premises and the making of such other provisions as it considers necessary or desirable, is a statutory function of individual fire authorities under the provisions of the Fire Services Act 1981 and 2003. Dublin City Council provides the fire service for the four Dublin local authorities – Dublin City Council itself, Dunlaoghaire/Rathdown, Fingal and South Dublin County Councils.

My Department supports fire authorities through the setting of general policy and guidance and the provision of capital funding, including the recoupment (within the overall funding available) of costs incurred by fire authorities in relation to approved construction projects and the purchase of fire appliances and equipment. The current national priority for capital funding is supporting the fire appliance fleet. Dublin Fire Brigade has been approved for 2 new appliances, which are at the tender stage of the procurement process.

A proposal to extend Tallaght fire station was approved in principle under the 2006 Fire Services Capital Programme. However, given the current constraints on public finances it has been necessary, in keeping with other reductions, to reduce the fire service capital allocations in 2011, 2012 and 2013. Accordingly, my Department is not in a position at present to fund the significant investment (circa €3 million) required to progress the extension of Tallaght Fire Station.

As an alternative, in light of the business case made by Dublin City Council in August 2011, my Department approved grant-aid of €300,000 to supplement funding committed by the Council in respect of necessary and urgent works at the fire station. These necessary upgrading works were completed during 2012 and grant-aid of €300,000 was paid by my Department in respect of this.

Water and Sewerage Schemes Funding

Deputy Michelle Mulherin asked the Minister for the Environment, Community and Local Government if he will prioritise the funding of a feasibility study for the development of a regional water supply scheme from Lough Mask to ensure a sustainable and good water supply to towns in east Mayo including Foxford, Swinford, Charlestown, Killkelly and Knock Airport whose current water sources are vulnerable and not satisfactory; and if he will make a statement on the matter. A comprehensive range of new water services infrastructure has been approved for County Mayo in my Department’s Water Services Investment Programme 2010 – 2013, a copy of which is available in the Oireachtas Library. The total value of contracts underway and those proposed for commencement during the period of the Programme in County Mayo is over €71 million.

The Lough Conn / East Mayo Regional Water Supply Scheme, which includes the areas of Foxford, Swinford, Charlestown, Kilkelly and Knock Airport, is included among the schemes to advance through planning during the period of the Programme. My Department recently approved Mayo County Council’s brief for the engagement of a consulting engineer to prepare a feasibility study for the Lough Conn / East Mayo Regional Water Supply Scheme.

Mortgage to Rent Scheme Application Numbers

Deputy Ciarán Lynch asked the Minister for the Environment, Community and Local Government the number of households that have availed of the mortgage to rent scheme to date; the number of applications that have been made to each bank; the number that were approved; the number in the Dublin area; the number in the rest of the country; and if he will make a statement on the matter. On foot of the recommendations of the Keane Report on mortgage arrears, the Government launched a mortgage to rent scheme on a pilot basis in February 2012. This scheme was extended nationally in June 2012, targeting low income families whose mortgage situation is unsustainable and where there is little or no prospect of a significant change in circumstances in the foreseeable future. The scheme ensures that the family remains in their home, while ownership is transferred to an approved housing body who in turn rent it to the original owners.

Householders seeking to avail of the mortgage to rent scheme must:

- have had their mortgage deemed unsustainable under a Mortgage Arrears Resolution Process as provided for under the Central Bank’s Code of Conduct on Mortgage Arrears;

- agree to a voluntary repossession of their home;

- be eligible for social housing support; and

- not have significant positive equity in the property.

Limits on household income, property value and applicant assets also apply. Borrowers wishing to avail of this scheme may access further information on the Housing Agency website, www.housing.ie

Light Pollution

There is no environmental legislation pending or in force, at either EU or national level, on light pollution. However, steps have been taken at a national level to help alleviate the effects of such pollution.

Irish regulations on environmental impact assessment (of projects which are likely to have significant effects on the environment) require an environmental impact statement to include an estimate of expected residues and emissions from the operation of the proposed development. This requirement expressly covers impacts from artificial lighting.

While a very limited number of planning authorities have included objectives in their development plans in relation to the minimisation of light pollution, it is open to authorities to address this issue in the context of providing for the proper planning and sustainable development of their areas through their development plans.

There are currently no provisions in planning legislation that require planning applications to be accompanied by lighting plans. Under Section 34 of the Planning and Development Act 2000 planning authorities may attach such conditions to the grant of planning permission as they consider necessary for the proper planning and sustainable development of the area.

Crime Prevention

I am informed by the Garda authorities that the area referred to is in the Ashbourne Garda District.

I am further informed that the area is subject to regular patrols by local uniformed and plain clothes personnel, augmented by the Detective Unit and the Community Policing Unit, together with the Divisional Traffic Unit and the Regional Support Unit as required.

Local Garda management closely monitors such patrols, and other operational strategies in place, in conjunction with crime trends and policing needs of the communities in these areas to ensure optimum use is made of Garda resources to provide the best possible Garda service to the public. While the situation is being kept under review, Garda management is satisfied that a full and comprehensive policing service is being delivered to the communities in the areas concerned and that the current structures in place deliver an effective and efficient policing service.

The Deputy will be aware that the Garda Commissioner has put Operation Fiacla in place in order to address incidents of burglary, aggravated burglaries and related offences throughout the country. Operation Fiacla is intelligence driven and specific burglary initiatives have been implemented in each Garda Region to target suspect offenders. I am informed that as of 31 January 2013, 3,903 persons have been arrested and 2,142 persons have been charged with burglary offences under Operation Fiacla.

An Garda Síochána also places great emphasis on the importance of community partnerships such as Community Alert and Neighbourhood Watch, in preventing and detecting crime, and maintaining a safe environment for everyone. Gardaí continue to invest time and energy in these partnerships and relationships to the benefit of all.

Civil Legal Aid Issues

I wish to inform the Deputy that the Legal Aid Board is the statutory independent body responsible for the civil legal aid scheme in Ireland. The Board provides legal aid and advice in civil law matters, including asylum matters. Exchequer funding for the scheme is provided by way of a grant in aid to the Board. The funding provided to the Board for the relevant years is set out. The Deputy should note that the 2012 allocation includes funding in respect of the Family Mediation Service, for which the Board assumed responsibility in late 2011.

Criminal Legal Aid

Total expenditure on criminal legal aid for the years referred to by the Deputy was as follows:

The total expenditure for 2012 represented a reduction of 10% over 2011. This reduction in the annual expenditure is the largest ever recorded and represents a fall of approximately €10 million, or 16%, over the peak recorded in 2009. The reductions follow savings measures I have introduced since coming into office including cuts to fees in 2011.
