Ceist:

401. Deputy Caoimhghín Ó Caoláin asked the Minister for Social Protection the reason for the delay in assessing the appeal of a person (details supplied) in County Cavan; when their file will be assessed; if her attention has been drawn to the fact that dealy in assessing the file has meant that the local office are powerless in dealing with the person until the file is returned and the person is suffering financially; and if she will make a statement on the matter. I am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all the available evidence, including that adduced at oral hearing, disallowed the appeal of the person concerned. In light of representations, the case was referred back to the Appeals Officer for review. The Appeals Officer has decided a revision of his original decision is not warranted in this case and has requested the Department to review the means of the person concerned in light of any changed circumstances. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
