144. Deputy John Lyons asked the Minister for the Environment, Community and Local Government if local authorities can apply parking charges to privately owned car parks in retail parks; and if he will make a statement on the matter. [28269/13]
Amharc ar fhreagraA local authority has powers to make bye-laws for or in relation to the use, operation, protection, regulation or management of any land, services or any other matter provided by or under the control or management of the local authority, whether within or without its functional area or in relation to any connected matter (section 199 (1) of the Local Government Act 2001). The application of parking charges on privately-owned land is a matter for the owner concerned and not the local authority.
