370. Deputy Robert Troy asked the Minister for Justice and Equality if he will prioritise the enactment of the National Vetting Bureau (Children and Vulnerable Persons) Act; and if he will outline the timeframe for same. [28845/13]
Amharc ar fhreagraThe National Vetting Bureau (Children and Vulnerable Persons) Act 2012 was enacted in December 2012. However, commencement of the Act has been delayed as elements of the Act relating to the disclosure of convictions are under review having regard to a subsequent judgment of the UK Court of Appeal in (on the application of) T and others v Chief Constable of Greater Manchester and others [2013]. In that case, the Court considered the circumstances in which it is appropriate to disclose convictions for minor offences with particular regard to Article 8 of the European Convention on Human Rights (right to privacy). It is my view that the principles identified by the Court in relation to the application of Article 8 merit consideration. To that end, my Department is engaged in ongoing consultation with the Office of the Attorney General to determine if there are any implications for the legislation which would require to be addressed in advance of commencement.
