674. Deputy Patrick Nulty asked the Minister for Arts, Heritage and the Gaeltacht the steps he will take to ensure the protection of a protected structure (details supplied) in Dublin 5, in view of its local architectural and heritage importance; and if he will make a statement on the matter. I understand that the property identified by the Deputy is on the Record of Protected Structures for Fingal County Council and is of significant historical and architectural merit. Part IV of the Planning and Development Acts 2000 (as amended) provides for the protection of architectural heritage. The Act gives primary responsibility to planning authorities to identify and protect the architectural heritage by including them on the Record of Protected Structures.

Section 58 of the Act places a duty of care on the owners and occupiers of protected structures. Sections 59 and 60 of the Act give the planning authority, in this case Fingal County Council, powers of enforcement in relation to the endangerment of protected structures. I refer the Deputy to Fingal County Council as the appropriate enforcement authority in this case.
