334. Deputy Seamus Kirk asked the Minister for the Environment, Community and Local Government if local authorities will be empowered to carry out repair and maintenance work to local housing estates which are not taken over by the county council; and if he will make a statement on the matter. Responsibility for compliance with the terms and conditions attaching to a planning permission is legally a matter for the developer. Until such time as a development is taken in charge, housing estates remain in private ownership and the responsibility of the developer. Local authorities are not empowered to enter onto private lands for the purpose of carrying out repair and maintenance work to housing estates until such time as the development has been completed to the satisfaction of the planning authority by the developer and formally taken in charge under section 180 of the Planning and Development Act, 2000 (as amended).
