761. Deputy Catherine Murphy asked the Minister for the Environment, Community and Local Government his plans to draft secondary legislation in relation to section 130 of the Local Government Act 2001; if so, to the time frame for same; and if he will make a statement on the matter. [23199/15]
Amharc ar fhreagraSection 130 of the Local Government Act 2001 states that it is a function of the elected council of a local authority to determine by resolution the policy of the authority subject to and in accordance with the Act and the other enactments relating to that authority. The section does not contain a power to make related secondary legislation.
