I have asked the HSE to respond to the Deputy directly on this matter as the Deputy refers to the individual being an ex-employee of the HSE. If you have not received a reply from the HSE within 15 working days please contact my Private Office and they will follow up these matters with them.

However, it appears that the individual may be an employee of a Section 39 service provider. During the recent Lansdowne Road talks the parties reached an agreement on a process for giving formal consideration to the matter. In the context of Service Level Agreements the HSE has with Section 39 agencies and taking account of paragraph 13 of the Appendix and "Service Delivery Options" to the Croke Park Agreement, the parties agreed to establish a working group to examine a number of issues relevant to these agencies including gratuity payments for home helps. The group, while operating under the aegis of the National Joint Council, is to arrange its first meeting within four weeks and is scheduled to conclude its business by 30th September 2015.

Deputy Michael Fitzmaurice asked the Minister for Health further to Parliamentary Questions Nos. 446 and 449 of 31 March 2015, if he will direct the Health Service Executive to provide the information requested, which he committed to provide to this Deputy within 15 working days of 31 March 2015, and which this Deputy has still not received, in spite of repeated requests from this Deputy to the executive; if he will provide an explanation to Dáil Éireann as to the reasons the executive has failed to provide the requested information, or a satisfactory explanation for the said failure; and if he will make a statement on the matter. Department officials have contacted the HSE about this matter. The HSE has explained that the Deputy's original questions sought information about the Rural Practice Allowance covering the past ten years and specifically requested information about average payments for each of those ten years for all GPs in receipt of a Rural Practice Allowance. The HSE has advised that the provision of this information requires a significant amount of analysis. The Executive has stated that it is working to provide the data as soon as possible and will forward it directly to the Deputy when available.

The vision for the Health Service Executive's (HSE) Disability Services Programme is to contribute to the realisation of a society where people with disabilities are supported, as far as possible, to participate to their full potential in economic and social life, and have access to a range of quality personal social supports and services including respite care to enhance their quality of life.

Respite care for children and adults with disabilities is provided by the HSE directly in some instances, or by agencies funded by the HSE to provide services on its behalf. In many instances respite services are part of the overall suite of services provided by voluntary service providers to people with disabilities under their service level agreements with the HSE. The HSE remains committed to working with all voluntary disability service providers to ensure that all of the resources available for specialist disability services, including respite services, are used in the most efficient and effective manner possible.

The HSE’s Social Care Operational Plan for 2015 aims to provide 190,000 overnight stays in centre-based respite services to almost 5,300 people. The HSE is also committed to continuing to explore methods of community respite care as an alternative to centre-based respite care, including advancing the Host Family Support Model.

In relation to the specific query raised by the Deputy, as this is a service issue, it has been referred to the HSE for direct reply. If the Deputy has not received a reply from the HSE within 15 working days, he can contact my Private Office and they will follow up the matter with the HSE.

Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

The National Waiting List Management Policy, A standardised approach to managing scheduled care treatment for in-patient, day case and planned procedures, January 2014, has been developed to ensure that all administrative, managerial and clinical staff follow an agreed national minimum standard for the management and administration of waiting lists for scheduled care. This policy, which has been adopted by the Health Service Executive, sets out the processes that hospitals are to implement to manage waiting lists.
