Rent Supplement Scheme Payments

Deputy Anne Ferris asked the Tánaiste and Minister for Social Protection her views on the output from recent research by the Economic and Social Research Institute on private property rental carried out on behalf of the Private Residential Tenancies Board, particularly in relation to the disproportionate increase in recorded rents in cities and in certain other parts of the country closely linked to cities, including parts of County Wicklow; her views on the need to again address the renewed inadequacy in rent supplement payable in certain parts of the country; the solutions under consideration by her to address the rent supplement problem until average rents start to fall again; the effect the current situation is having on homelessness and the growth in the housing list; and if she will make a statement on the matter. The rent supplement scheme provides support to eligible people living in private rented accommodation whose means are insufficient to meet their accommodation costs and who do not have accommodation available to them from any other source. There are approximately 68,000 rent supplement recipients, with over 2,060 recipients in the Wicklow area. The Government has provided over €298 million for the scheme in 2015.

I fully acknowledge the difficulties that people are experiencing, including rent supplement recipients, in maintaining suitable affordable accommodation in the current market as a result of increasing rents, as set out in the research referred to by the Deputy. The Department’s recent review of the maximum rent limits found that market rents have been increasing significantly over the past 18 months, especially in major urban areas, with this increase in rents fundamentally attributable to a reduced supply of housing. The implementation of the range of actions under the Construction 2020 Strategy and the Social Housing Strategy will support increased housing supply.

The Department’s review also found that increasing rent limits at this time could potentially add to further rental inflation in an already distressed market, affecting not alone rent supplement recipients, but lower-income workers and students. Between the rent supplement scheme administered by this Department and the Rental Accommodation Scheme administered by the Department of the Environment, Community and Local Government, the State accounts for a third of the private rented market. The State is, therefore, a very significant player in the sector.

In response to these difficulties, the Department has put in place a number of preventative measures to ensure that people at risk of homelessness or loss of their tenancy are supported under the rent supplement scheme where increased rental payments are required. The Department’s preventative policy allows for flexibility in assessing customers’ individual accommodation needs through the National Tenancy Sustainment Framework. Under this approach, each tenant’s circumstances are considered on a case-by-case basis, and rents are being increased above prescribed limits throughout the country, as appropriate. Staff in the Community Welfare Service of the Department who administer the rent supplement scheme have a statutory discretionary power to award or increase a supplement for rental purposes, for example, when dealing with applicants who are risk of losing their tenancy. This flexible approach has already assisted over 2,100 rent supplement households nationwide to retain their rented accommodation through the payment of increased rent payments.

A Tenancy Sustainment Protocol in conjunction with Threshold was introduced in the Dublin region and Cork city where supply is particularly acute. The primary objective of the Protocol is to ensure a speedy intervention to ensure that families and persons at immediate risk of losing their tenancy get rapid assistance. Of the 2,100 households referred to above, almost 700 households in Dublin have been supported as a result of engagement under the Protocol and over 20 households in Cork City.

The Department has also undertaken a communications campaign which seeks to encourage people at risk to contact the Department or the Threshold Tenancy Protection service as early as possible to prevent an unnecessary episode of homelessness. The actions undertaken include issuing text messages to over 50,000 rent supplement recipients, issuing monthly tweets to Department followers, updating the Department’s website and the distribution of posters to Department Offices, Post Offices, Citizen Information Centres, MABs offices and Oireachtas members. The Department’s response to the current housing difficulties remains under review to ensure that the appropriate supports continue to be provided.

The issue of social housing lists is a matter for my Government colleague, Alan Kelly T.D., Minister for the Environment, Community and Local Government.

The rent supplement for the client concerned is currently suspended as their One-Parent Family Payment has ceased and her case referred to the Appeals Unit for review. Should this payment be reinstated, the client's Rent Supplement, to include any arrears due, can issue accordingly.

As detailed to the Deputy in reply to Parliamentary Question No 72 of 2nd April 2015, the customer concerned has been requested to provide the Department with an amended Rent Supplement application, current payslip and up to date lease agreement, confirming any increase in monthly rent. This information has not, to date, been received by the Department. On receipt of same, the customer's rate of Rent Supplement entitlement can be re-assessed.

The person concerned is not in receipt of a one-parent family (OPF) payment but receives a jobseeker’s allowance payment with a weekly entitlement of €217.80. As the person concerned is a casual worker, for each day that she is employed €25.00 means per day is deducted. The person concerned has a dependent child under the age of 14 and as such the jobseeker’s transitional payment may be more financially beneficial to her. An application form for jobseeker’s transitional payment has been posted to the person concerned and it is open to her to complete and return this form to have her entitlement to this payment assessed.

The person concerned is currently in receipt of a one-parent family payment at the weekly rate of €185.30. In line with legislative changes, her claim will transfer to a jobseeker’s transition payment with effect from 02/07/2015 with a weekly entitlement of €159.80 assessed under this scheme for her current circumstances.

The person concerned applied for a carer’s allowance effective from 01/04/2015. Based on the medical evidence provided this claim was disallowed and a letter of disallowance issued to her on 08/06/2015. It is open to the person concerned to submit further medical evidence in support of her application and seek a review of her circumstances or alternatively she may submit an appeal to the Social Welfare Appeals Office if she is not happy with the decision of the deciding officer.

Carer's Allowance Appeals

I am advised by the Social Welfare Appeals Office that, to date, no appeal in respect of disallowance of Carers Allowance has been received from the person concerned.

In order to make a valid appeal the person concerned should write to the Social Welfare Appeals Office outlining her grounds of appeal i.e. the reason why she disagrees with the conclusions of the Deciding Officer. On receipt of same, an appeal will be opened.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to Social Welfare entitlements.

Household Benefits Scheme

Durkan asked the Tánaiste and Minister for Social Protection further to previous parliamentary questions and the replies thereto, if she will re-examine the application for household benefits currently refused in the case of a person (details supplied) in County Kildare, a recipient of invalidity pension who has been refused the payment on the basis that his offspring, a recipient of jobseeker's allowance, resides in the family home but is not in receipt of household benefits; and if she will make a statement on the matter. One of the conditions for receipt of the Household Benefits Package is that an applicant, under age 70 and who is not in receipt of a full time Carer's Allowance, must be living alone or only with certain excepted categories of people.

The person concerned was refused the Household Benefits package as his son, who is not an excepted person for Household Benefit purposes, is residing in the household. There is no new information provided which would warrant a revised decision in this instance.

Invalidity Pension Appeals

Durkan asked the Tánaiste and Minister for Social Protection if this inquiry will be accepted as grounds for appeal against a decision to refuse an invalidity pension in the case of a person (details supplied) in County Kildare, if the case will be reviewed; and if she will make a statement on the matter. Invalidity pension (IP) is a payment for people who are permanently incapable of work because of illness or incapacity and who satisfy the pay related social insurance (PRSI) contribution conditions.

The department received a claim for IP for the person concerned on 19 November 2014. The person concerned was refused IP on the grounds that the medical conditions for the scheme were not satisfied. He was notified on the 09 June 2015 of this decision, the reasons for it and of his right of review and appeal to the independent social welfare appeals office (SWAO).

The additional medical evidence submitted with your representations will be treated as a review and appeal request from the person in question. The review of the decision to disallow IP will be processed as quickly as possible and he will be notified directly of the outcome. If the decision to disallow is confirmed, his claim will be submitted to the SWAO for determination.
