The person named submitted a 2015 Basic Payment/Areas of Natural Constraint Scheme application on 15 May 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Remote Sensing (i.e. satellite) inspections, be completed before any payments issue.

The application of the person named was selected for a Remote Sensing eligibility inspection. This inspection is currently being finalised with the intention of issuing any payments due under the Direct Payment Schemes as soon as possible. In the event that any queries arise officials in my Department will be in contact with the person named.

Harbours and Piers Funding

176. Deputy Michael Healy-Rae asked the Minister for Agriculture, Food and the Marine for an update on funding that is required at Scraggane Pier, Maherees, Brandon, Tralee, County Kerry; and if he will make a statement on the matter. [36948/15]

Scraggane Pier is owned by Kerry County Council and responsibility for the maintenance and development of the pier rests with that local authority in the first instance and its parent Department, the Department of Environment, Community and Local Government.

My Department, however, provides funding for the development and repair of Local Authority owned piers, harbours and slipways under the annual Fishery Harbour and Coastal Infrastructure Development Programme subject to available Exchequer funding and overall national priorities.

My Department received an application for works at Scraggane Pier from Kerry County Council under the 2015 Fishery Harbour and Coastal Infrastructure Development Programme. The works include stabilisation works and underpinning of the pier.

I am happy to confirm to the Deputy that funding of €22,500 has been approved for Scraggane pier under this Programme.

Single Payment Scheme Applications

Deputy Willie Penrose asked the Minister for Agriculture, Food and the Marine the steps he will take to ensure that the appropriate rectification is carried out in respect of lands which are being farmed by a person (details supplied) in County Longford and for which the person has submitted the appropriate evidentiary documentation to indicate due entitlement to the payments arising from same; that this is dealt with without further delay; and if he will make a statement on the matter. The person named submitted an application for the Basic Payment/Areas of Natural Constraint Schemes which was received in the Department on 18th May 2015.

On examination of this application, a dual claim on a land parcel was identified between the person named and another herd owner. Both herd owners were written to seeking documentary evidence of their right to claim this particular land parcel. Both claimants are given a prescribed period of time to reply to my Department before a decision is made by the appropriate Official. The period allowed for both claimants to reply has not yet expired.

As soon as the two replies are received the Department will further process the application of the person named and any payment due will issue as soon as possible to his nominated bank account.

As the Deputy will appreciate the Garda Commissioner is responsible for the distribution of personnel among the Garda Regions, Divisions, and Districts. Garda management keep this distribution under continual review in the context of crime trends and policing priorities so as to ensure that the best possible use is made of resources. The information regarding the number of Gardaí allocated to each Garda Division and District in Cork City and County as of 31 August 2015, the latest date for which figures are readily available, and the corresponding figures for October 2010 is as set out in the following tables.

Domestic Violence Incidence

As the Deputy will be aware the Central Statistics Office (CSO), as the national statistical agency, is responsible for the publication of recorded crime statistics.

In relation to the matters referred to, I have requested the CSO to provide the available statistics directly to the Deputy.

Residency Permits

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that there is no record of an application for a right of residency in the State, accompanied by the right to work, based on parentage of an Irish citizen child in respect of the person referred to by the Deputy.

I am also informed that INIS has recently developed a new application form for these types of applications and further information on the application process, including guidelines for completing the form, can be found on the INIS website www.inis.gov.ie.

Garda Misconduct Allegations

186. Deputy Finian McGrath asked the Minister for Justice and Equality if she will support a matter (details supplied) regarding corruption; and if she will make a statement on the matter. [36828/15]

The particular case to which the Deputy refers is amongst those considered under the mechanism established for the independent review of certain allegations of Garda misconduct, or inadequacies in the investigation of certain allegations, which have been made to me as Minister for Justice and Equality, or the Taoiseach, or other public representatives with a view to determining to what extent and in what manner further action may be required in each case. A panel consisting of two Senior and five Junior Counsel was established for the purpose, all selected on the basis of their experience of the criminal justice system.

The Panel has provided recommendations to me in all 320 cases submitted to them and has therefore largely concluded its work. I am mindful that all complainants are anxious to know the outcome of the review of their case and every effort is being made to conclude the process. In each case a submission will be prepared. Mr. Justice Roderick Murphy will review the summary of the conclusion and the letter of notification drafted to ensure that they are a fair and accurate reflection of the recommendation.

The issuing of notification letters to complainants commenced on 29 June. To date, 216 complainants have been notified of the outcome of the review of their cases. Letters will continue to issue to all complainants, including the individuals referred to in this case, until the process is completed.

I have previously assured Deputies that where further investigation is recommended by the review then that will occur. It is my intention, on the completion of the process, to make a comprehensive statement on all the actions I have decided to take in line with the recommendations of counsel.
