Water Services Provision

Deputy Michael Lowry asked the Minister for the Environment, Community and Local Government if he is aware of a large number of houses in County Tipperary with possible lead piping and the potential cost of removing lead piping from these homes; the number of homes in County Tipperary which Irish Water suspects to have lead piping or has confirmed contain lead piping, in tabular form; when the grant for homeowners affected with lead piping will be launched; the proposed income thresholds for such a grant; the proposed monetary amounts which will be made available to applicants; and if he will make a statement on the matter. Since 1 January 2014, Irish Water has statutory responsibility for all aspects of water services planning, delivery and operation at national, regional and local levels. The Environmental Protection Agency (EPA) is the supervisory authority for public water supplies. The procedures to be followed where there is non-compliance with the parametric value for lead of 10 microgrammes per litre, and the roles of the water supplier, the EPA and the Health Services Executive (HSE), are set out in the European Union (Drinking Water) Regulations 2014, a copy of which is available in the Oireachtas Library.

I have no role in monitoring implementation of the Regulations. However, I understand that Irish Water is in the process of advising its customers where the presence of lead pipes on the customer side, which may result in exceedances of the statutory limit, has been identified as part of its ongoing domestic metering programme. Irish Water has established a dedicated team to deal with representations and queries from public representatives. The team can be contacted via email to oireachtasmembers@water.ie or by telephone on a dedicated number, 1890 578 578.

On 9 June 2015, I announced a Government-approved National Strategy to reduce exposure to lead in drinking water. The Strategy was prepared by my Department and the Department of Health in consultation with Irish Water, the HSE and the EPA, in order to map the scale of the problem and identify measures to mitigate any risks to human health posed by lead in drinking water. As part of the Strategy, I will be establishing a new grant-aid scheme to assist low income households to replace lead pipes in their homes.

It is envisaged that the scheme will be administered by the local authorities and that income thresholds and other eligibility criteria will apply. The terms and conditions of the new scheme, including the eligibility criteria, will be publicised as soon as they are finalised.

Farm Waste Management

Deputy Dominic Hannigan asked the Minister for the Environment, Community and Local Government his views on the spreading of human waste as slurry or fertilizer on Irish farmlands; the measures that are in place to protect the environment and human health in relation to this matter and to ensure that there is no negative impact or nuisance caused to the persons living close to where the human waste is being spread; and if he will make a statement on the matter. The spreading of sewage sludge is subject to a range of regulatory controls under waste management, water protection, planning and other applicable legislation. Persons seeking to spread sewage sludge are required, inter alia, under waste management legislation to:

- ensure that sludge is not used except in accordance with a nutrient management plan in line with the Waste Management (Use of Sewage Sludge in Agriculture) Regulations 1998;

- satisfy themselves as to whether a Waste Licence, Permit or Certificate of Registration is also required for their proposed spreading activity and apply to the relevant authority where necessary;

- apply to the Local Authority in whose area the sludge is to be stored, as required under the Waste Management (Registration of Sewage Sludge Facility) Regulations 2010;

- supply the information required for the Sludge Register to the Local Authority, in a format and frequency required by the Local Authority; and

- ensure that vehicles transporting the waste hold a Waste Collection Permit as required under the Waste Management (Collection Permit) Regulations 2007.

There is also an onus on a person to investigate whether the activity of spreading or the storage of sewage sludge requires Planning Permission.

All land-spreading, including the spreading of sewage sludge, is required to be carried out in accordance with the European Union (Good Agricultural Practice for Protection of Waters) Regulations 2014. The Regulations are designed to provide additional protection to waters from agricultural sources and include measures such as:

- set periods when the land spreading of fertilisers are prohibited;

- limits on the land application of fertilisers;

- set distances from water bodies including boreholes, springs and wells for the abstraction of water used for human consumption;

- storage requirements; and

- record keeping.

In addition to the above, local authorities require that the spreading of sewage sludge is subject to compliance with relevant codes of practice, e.g. Code of Good Practice for the Use of Biosolids in Agriculture. This Code has been designed to ensure that the use of biosolids in agriculture will, inter alia, not pose a risk to human, animal or plant health, avoid water and air pollution, and minimise public inconvenience. In this regard, the Code includes guidelines on the minimum buffer zones to be observed when spreading biosolids in the vicinity of particular structures or features, such as sensitive buildings, dwellings, domestic wells, lakes or small watercourses.

Pyrite Remediation Programme Expenditure

1109. Deputy Clare Daly asked the Minister for the Environment, Community and Local Government the moneys allocated in budget 2016 for the pyrite remediation scheme in 2016. [38310/15]

A sum of €19 million was announced under Budget 2016 to fund the operation of the pyrite remediation scheme in 2016. This represents a substantial increase over the allocation of €10 million provided in 2015 and is a clear signal of the importance attached by Government to addressing the issue of pyrite remediation and will facilitate an acceleration in activity under the scheme in 2016.

The latest figures available indicate that approximately 897 applications have been received under the pyrite remediation scheme of which 664 have been approved for inclusion in the scheme as follows:

- 239 are at remedial works planning stage,

- 46 are at tender/tender analysis,

- 171 are at tender decision,

- 106 are under remediation, and

- 102 are complete.

It is anticipated that circa 230 dwellings will be remediated, or under remediation, by end 2015, and an estimated 500 dwellings will be remediated, or under remediation, by mid-2016.

Harbours and Piers Development

An allocation of €8 million was announced in the Capital Investment Plan 2016-2021 for the development of pier facilities on Inis Oirr. I will be consulting with my colleague, the Minister for Arts, Heritage and the Gaeltacht, who has the lead role for offshore islands, on the proposals for developing the pier at Inis Oirr. Responsibility for the investment in the harbour at Ros a’Mhil falls under the responsibility of my colleague, the Minister for Agriculture, Food and the Marine.

My Department publishes a wide range of housing statistics. The statistics are available on my Department’s website at:

Statistics relating to the overall number of houses previously sold as affordable homes under local authority Affordable Housing schemes that are now rented out by the current owner are not collected by my Department.

However, Department records show that to the end of September 2015, under the Social Housing Current Expenditure Programme (SHCEP), previously known as the leasing initiative), 2,111 unsold affordable units were in use as social housing. A breakdown of these units by local authority is shown in the following table. These units are rented to social housing tenants.

Mortgage Arrears Proposals

The Mortgage Arrears Resolution Process (MARP) is being implemented across all local authorities. My Department issued revised guidelines to local authorities for dealing with mortgage arrears within the local authority sector in June 2014. Dealing with Mortgage Arrears – A Guide for Local Authorities is available on my Department’s website by clicking on the following link:

Extending the term of the mortgage to a maximum of 35 years and a maximum borrower age of 70, depending on the type of loan, the remaining term and the circumstances of the individual borrower, as well as adding arrears and interest to the principal amount due at the interest rate applicable to the parent mortgage, are long term resolutions available to borrowers in mortgage arrears distress. In addition, a Mortgage to Rent scheme, specifically for local authority mortgage borrowers, is also available as part of the MARP arrangements.

In cases of acute mortgage arrears distress, all homeowners also have the option of seeking to avail of the legal process now also in place to deal with personal insolvency. The most important step any family in arrears can take is to engage early with the Arrears Support Unit of the local authority. Solutions are available and advice should be sought as early as possible.

Social and Affordable Housing Provision

1114. Deputy Seán Crowe asked the Minister for the Environment, Community and Local Government the options for families in affordable homes if they cannot live in these homes due to overcrowding. [38343/15]

The allocation of an affordable home was made on the basis that an individual was in need of housing, was a first time buyer, could not afford to purchase privately on the open market but could service a mortgage obtained by loan through an approved financial institution or a local authority where private finance has been refused. All Local Authority affordable housing schemes were stood down in 2011.

In order to prevent short-term profit taking on the resale of the house to the detriment of the objectives of the schemes, houses sold to first time buyers under the various affordable housing schemes, at a significant discount from market value, contain a clawback provision. However, where a person is selling an affordable home and the clawback amount payable would reduce the proceeds of resale below the initial price actually paid, the legislation provides for the amount of the clawback payable to be reduced to the extent necessary to avoid that result. A breach of contract conditions would be a matter for a local authority to pursue as it considers appropriate given the particular circumstances involved.

The State provides a wide range of supports to assist households in meeting their housing need ranging from income support and rent supplement, provided through the Department of Social Protection, to social housing supports provided by my Department, local authorities and approved housing bodies.

In order for a household to qualify for social housing support, a housing authority must carry out an assessment to establish whether the household meets specified eligibility requirements and has a housing need.  The housing need criteria, as prescribed in the Social Housing Assessment Regulations 2011 include a requirement to have regard to whether the applicant’s current accommodation is overcrowded within the meaning of Section 63 of the Housing Act 1966. The allocation of social housing supports to qualifying households is a matter for each housing authority in accordance with its allocation scheme made under the Housing (Miscellaneous Provisions) Act 2009.

Dumping at Sea

Deputy Terence Flanagan asked the Minister for the Environment, Community and Local Government if he is aware of the application lodged by the Dublin Port Company to dump dredged material at sea, off the coast of Howth Head in County Dublin; if he is satisfied that there will be no impact on the Dublin Bay environment when the material is dumped; and if he will make a statement on the matter. I understand that the Dublin Port Company submitted a Dumping at Sea permit application to the Environmental Protection Agency (EPA) on 13 July 2015 relating to dredging at Dublin Port as part of the Alexandra Basin redevelopment project. As the designated competent authority, the EPA will assess the application in accordance with the Dumping at Sea Act and will make a decision accordingly.

Inland Fisheries

Deputy Robert Troy asked the Minister for Communications, Energy and Natural Resources if he is aware that there is an invasion of the Asian clam species in the Shannon river which has the potential to harm and eradicate the fish there; and if he will make a statement on the matter. Since first reports of Asian Clam, Inland Fisheries Ireland (IFI) has acted proactively erecting public warning signs and installing essential bio-security stations, notwithstanding the fact that neither my Department nor IFI has a statutory remit in the area of invasive species. I am advised by IFI that its early intervention in this issue has primarily concentrated on its core statutory responsibilities as regards the protection conservation, development and promotion of the inland fisheries resource.

IFI, together with the ESB undertook work to reduce the threat of further spread from angling activity and equipment. This was completed promptly and, with appropriate bio-security measures in place for anglers, the fishery was re-opened. IFI also contributed to the organisation of an international angling competition at Lanesborough aimed at showcasing the reopened fishery. It is understood, however, that the main potential vectors as regards spread of the species are outside the remit of IFI.

IFI also engaged, as a groundwork measure, in a scientific survey in the Lanesborough area which sets out many of the physiognomies of the species.

It would appear that the statutory remit in this matter rests with the National Parks and Wildlife Service (NPWS) and it is clear that a multi-agency response to the substantive issue is required, with the National Parks and Wildlife Service (NPWS), as the body with a statutory remit, in the lead. I have agreed with the Minister for Arts, Heritage and the Gaeltacht, who has responsibility for NPWS, to continue working collaboratively on this issue.

My officials have again formally contacted the officials in NPWS to support a collective multi-agency approach and officials will meet shortly to discuss. IFI has confirmed to me that it is ready and willing to participate in a multi-agency group and to contribute any expertise it has in this regard.

It is important to emphasise that scientific expertise clearly indicates that this species is particularly pervasive in the environment and that eradication does not appear to be a viable option but that ongoing management of the situation, on a multi-agency basis, may be required. Assessment, on a multi-agency basis led by NPWS, may have to be made on the potential risks in disturbing the existing population.

Inland Fisheries Ireland Funding

The 2016 Estimates provision for inland fisheries, which encompasses Inland Fisheries Ireland and the Loughs Agency, is €27.021 million, an increase of almost €700,000 on the 2015 provision.

The establishment of IFI in 2010 has facilitated an improved national perspective in the formulation of inland fisheries policy which is more streamlined, coherent and integrated. It also facilitates the achievement of efficiencies in the effective management of the inland fisheries resource.

The Deputy will also appreciate that the Board and Senior Management of IFI have a key role in ensuring that the Agency continues to meet its objectives towards the conservation, protection, promotion and development of the inland fisheries resource. In achieving its objectives, IFI is delivering on the imperative, common to all Public Bodies, to achieve efficiencies and to maintain a high level of service.

IFI staff have embraced a range of changed work practices to improve operational efficiency. These include the increased use of technology and specialist vehicle and water craft patrols. These innovations underpin the imperative of ensuring the optimum deployment of resources.

I can confirm that an increase in staff numbers to 312 has been authorised and that sanction was received in 2015 for 35 additional temporary seasonal staff.

Energy Resources

Deputy Sandra McLellan asked the Minister for Communications, Energy and Natural Resources if he is concerned that the Phillips 66 company has commenced a process to sell Whitegate Oil Refinery in Cork; the steps he is taking to ensure that we maintain a refining capacity on the island of Ireland, due to its strategic importance; and if he will make a statement on the matter. My Department is in regular contact with Phillips 66, the company operating the refinery at Whitegate, and officials have met recently with both management and union representatives. In the last year I have met with Irish and US executives of Phillips 66 and I visited the refinery in November 2014. My most recent engagement with union representatives was a fortnight ago.

In 2013 Phillips 66 placed the refinery and marketing business up for sale and subsequently withdrew it from that process in 2014. The company advised my Department last month that they are putting the refinery and marketing business back up for sale on the market. A refinery sale would be a commercial matter between Phillips 66 and a potential purchaser.

As this process is underway Whitegate will continue to be operated on a business as usual basis. My understanding from Whitegate management is that they are committed to honouring the 15 year agreement under the 2001 Sale and Purchase Agreement to keep the refinery operational until at least July 2016. That commitment is not affected by the planned sale.

The Government views the continued operation of the Whitegate refinery on a commercial basis as highly desirable from an energy security and economic perspective. Security of supply remains a fundamental tenet of our energy policy. I am in contact with my Ministerial colleagues to discuss the importance of continued operations at the facility.

The 2016 allocation for my Department and its Agencies to meet the pay and pension increases from the Lansdowne Road Agreement is €72,000. In addition, appropriation-in-aid receipts for my Department will be reduced by €885,000 reflecting lower Pension Related (Pension Levy) deductions from salaries. The overall allocation for my Department in 2016 has increased by 4.2% compared to 2015. Details of the allocations are set out in the Expenditure Report 2016 published on 13 October.

There have been 174 appointments to State Boards under the aegis of my Department in the period 7 March 2011 to date. 34 of these were from among individuals who submitted Expressions of Interest or who applied under the revised arrangements set out in the Guidelines on Appointments to State Boards which were published in November 2014. It should be noted that some 48% of the appointments made were either ex-officio appointments, reappointments, the appointment of worker directors chosen by election or appointments made on foot of nominations made by an Oireachtas Committee. There are currently 15 vacancies on State Boards under the aegis of my Department. Of these 7 relate to the Digital Hub Development Agency and in light of the merger of that Agency with Dublin City Council, I do not propose to make further appointments at this time. The remaining vacancies will be filled in accordance with the relevant statutory provisions and the Guidelines on Appointments to State Boards.
