Deputy Pearse Doherty asked the Minister for Agriculture, Food and the Marine further to Parliamentary Question No. 376 of 21 April 2015 regarding the 2011 Killybegs County Donegal jobs initiative, if he has since received information which was previously unavailable to him on the number of jobs created in areas outside of those he referred to in his response, which were created within the seafood processing sector; if the overall aim of the initiative, which was to create 250 jobs in the region, has been achieved; if he will provide a comprehensive breakdown of these jobs, including the industries in which they were created; and if he will make a statement on the matter. On 3 June 2011, I announced a pilot jobs initiative for Killybegs, following the launch of an economic report for the European Commission, which assessed the status, development and potential diversification of Killybegs as a fisheries dependent community. The aim of this initiative was to create 250 cross sectoral jobs in the Killybegs area by 2014. Seafood processing was just one of the areas identified as having the potential to create additional employment. To drive forward the initiative, I established a High Level Group on Job Creation in the Killybegs Region and requested that the Group identify the potential actions required to deliver job creation in the following five key areas, that is; promoting seafood value added activity; enhancing ancillary services; developing offshore supports; promoting tourism and marine leisure; and promoting the green economy and renewable energy.

The High Level Group comprised representatives of the Killybegs Fishermen's Organisation (who chaired the Group), Bord Iascaigh Mhara, Donegal County Council, Letterkenny Institute of Technology, Enterprise Ireland, local industry and from my Department. BIM provided secretariat services to assist the chair.

Since 2012, a local implementation group reporting to Donegal County Council has taken on responsibility for driving forward the initiative. The Council may be able to assist the Deputy with the information he is seeking.

I am informed by Bord Iascaigh Mhara that by the end of 2014, 89 jobs had been created in seafood processing companies in the Killybegs area. I do not have information available to me on jobs created in areas outside of my area of responsibility.

It is clear that the future is very promising for the seafood industry generally and Killybegs is central to that growth story. While the Killybegs Jobs Initiative was important in terms of fostering a diversified blue economy in Killybegs, seafood will continue to be the driver of economic growth for Killybegs in the years to come.

The seafood sector continues to be a high-growth area of the economy and indeed of our food industry. Exports have grown 70% since 2009 and the sector is now worth €850 million in sales. Bord Iascaigh Mhara and Bord Bia are working with seafood companies in Killybegs and elsewhere around our coast to grow the sector to €1 billion in the next few years. This will be driven by our seafood processing sector adding value to commodity products, innovating and developing new consumer seafood products, with the assistance of BIM’s Seafood Development Centres in Clonakilty and Killybegs, and winning new markets for Ireland’s top quality seafood.

Earlier this year, I announced a new €241 million Seafood Development Operational Programme under the European Maritime and Fisheries Fund. This new Programme will double the level of supports for the sustainable development of the seafood over the coming years. I expect that the new Programme will be adopted by the European Commission in November. My Department is working with Bord Iascaigh Mhara to have a range of supports ready to launch from the start of 2016 to support and promote the sustainable growth of the processing, aquaculture and fishing sectors through that Programme.

Animal Welfare

Deputy Clare Daly asked the Minister for Agriculture, Food and the Marine the number of times the maximum penalties for animal cruelty offences have been applied by the courts under the Animal Health and Welfare Act 2013; and if he is satisfied that the penalties provided for in that Act are a sufficient deterrent. The imposition of penalties under the Animal Health and Welfare Act is a matter for the Courts and I have no function in the matter. While my Department does not maintain records of penalties imposed by the courts, I am unaware of any cases so far in respect of which the maximum penalty has been imposed. I am satisfied that the penalties set down in the Act in respect of cruelty offences should provide a sufficient deterrent. These penalties are as follows: (i) on summary conviction, to a class A fine or to imprisonment for a term not exceeding 6 months, or to both, or (ii) on conviction on indictment, to a fine not exceeding €250,000 or to a term of imprisonment not exceeding 5 years, or to both.

An application under the 2015 Areas of Natural Constraints Scheme was received from the person named on 29 May 2015. Processing of the application was recently finalised and payment issued directly to the nominated bank account of the person named on 27 October 2015.

Knackery Industry

393. Deputy Brian Stanley asked the Minister for Agriculture, Food and the Marine the regulations preventing knackery owners who have a dog food licence from delivering dog food to customers, while at the same time customers may collect the dog food at the knackery. [37244/15]

Article 18(1)(f) of the EU Animal By-Products (ABP) Regulation (EC) 1069 of 2009 allows Member States, by way of derogation, to authorise, under conditions which ensure the control of risks to public and animal health, the collection and use of Category 2 and Category 3 ABP for feeding to dogs from recognised kennels and packs of hounds. Following an intensive consultation process, my Department introduced a new policy and procedures in this area on 1 May, 2015. The purpose of the new policy is, while allowing properly regulated economic activity to proceed, to mitigate the potential risk to both animal and public health, particularly from Category 2 ABP meat which is derived from fallen animals. The key elements of this policy are that:

i. Collection and sale of Category 2 and 3 ABP is restricted to Collection Centres, approved and supervised by the Department;

ii. Purchase and use of Category 2 and 3 ABP for greyhounds is restricted to Licensed Meat Feeders, authorised by the Department following a recommendation by either one of the greyhound bodies - Bord na gCon and/or the Irish Coursing Club (ICC) - on foot of the issue of a Recognised Kennel Authorisation (RKA).

Operators of authorised Collection Centres supplying relevant material other than fish offal to final users must ensure that the material being supplied is labelled appropriately and supplied only to authorised end-users; and the operator must verify authorisations in each instance. Collection Centres are fixed premises, facilitating effective supervision of controls, including the effective and reliable identification and denaturation of ABP by staining or other means. Such premises can, for example, be attached to a knackery (Category 2) or a slaughterhouse (Category 3), or can be an independent building. The sale of ABP meat from mobile units such as vans/trucks/lorries at any unauthorised venue is prohibited. The Department is reviewing the possibility of permitting direct delivery, by approved Collection Centres to Licensed Meat Feeders, on a pre-order basis and subject to compliance with strict conditions including use of refrigerated transport.

An application to afforest in the area identified by the Deputy was approved, subject to conditions, by my Department on 28 September 2015. Since then a number of objections have been received from third parties and a review of the decision is currently underway. As soon as this review is completed, the persons concerned and the applicant will be notified of the outcome.

To date this year there has been a transfer of funding, using the virement process, to allow for an increase of €3.4m on my Department’s ICT expenditure from savings projected to occur in the Market and Income Support allocation. This has been approved by the Department of Public Expenditure and Reform.

The actual gross expenditure incurred over the period 1 January to end October was €876.5m.

All elements of expenditure continue to be monitored on an ongoing basis, and potential savings and additional expenditure are under discussion with the Department of Public Expenditure and Reform.

Agri-Environment Options Scheme Payments

Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue. The cross-checks for the 2015 AEOS scheme year could only take place following the finalisation of the BPS applications for 2015 and the issuing of BPS payments. I anticipate that payments for the 2015 scheme year will commence towards the end of November for those that have successfully come through the administrative checks and where there are no outstanding issues for those who had on-the-spot inspections in 2015.

Lansdowne Road Agreement

The Department of Agriculture, Food and Marine has benefited from the productivity and reform measures provided for under the Haddington Road Agreement and previous agreements. These measures will continue to apply under the Lansdowne Road Agreement. The 2016 Administrative Budget estimate of €233.976m, which will fund all my Departments operational costs in 2016 includes €172.902m to fund staff pay arising in my Department in 2016. It is envisaged that the phased pay increases provided for in the Lansdowne Road Agreement will be absorbed within the 2016 estimate.

A focus on continued cost management will ensure that the Department maximises outcomes for the resources available.

There are a number of investment items available in the TAMS II Schemes for the control of farm yard pollution including the construction of nutrient storage facilities, and storage facilities for other farmyard manures, dairy washing and soiled water, and related facilities. The applicant has to be compliant with the Nitrates regulations at time of application. Statutory Instrument (S.I. 31 of 2014) for the Good Agricultural Practice for Protection of Waters Regulations refers. However, where the relevant authority has specified a higher winter storage period than that laid down in the S.I. this must be complied with. The investment items in question are available to all eligible farmers at a 40% rate of aid. Qualified young farmers are eligible for increased grants of 60%.

Tuberculosis Eradication Programme Payments

In general, a farmer only pays for one TB herd test each year and my Department pays for any consequential tests as a result of disclosure of TB.  However, in a limited number of specific circumstances, a farmer may be required to pay for more than one test in a year.   I have no plans to change these arrangements.

Since May 2011, a notification was placed on my Department’s website inviting expressions of interest from persons interested in being appointed to the boards of State Bodies under the aegis of my Department. The list of board vacancies was updated on a regular basis. A notification was also placed in National Newspapers. Since the end of November 2014, vacancies on the boards of these State Bodies, other than those which fall to be filled on the basis of nominations from specified organisations, are being advertised on www.stateboards.ie and processed in accordance with the Public Appointments Service (PAS) guidelines. In the case of the Aquaculture Licensing Appeals Board, Bord Bia, Teagasc, National Milk Agency, Veterinary Council of Ireland and Horse Racing Ireland board appointments, while made by me, are not all at my sole discretion in that individuals are nominated for appointment by me as specified in the relevant statute.

The person named submitted a 2015 Basic Payment /Areas of Natural Constraint Scheme application on 12 May 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Remote Sensing (i.e. satellite) inspections, be completed before any payments issue. The application of the person named was selected for a Remote Sensing eligibility inspection. This inspection is currently being processed with the intention of issuing any payments due under the Direct Payments Schemes as soon as possible. In the event that any queries arise officials in my Department will be in contact with the person named.
