Harbours and Piers

857. Deputy Robert Troy asked the Minister for Transport, Tourism and Sport when the Harbours Act will be commenced; the progress that is being made on transferring the harbours of regional significance to local authority control; if he will outline the bodies which will have responsibility for funding harbour dredging as well as major capital works and minor capital works on harbours upon transfer of ownership over the regional harbours; and if there are any specific delays relating to the transfer of Dún Laoghaire Harbour. The Harbours Act 2015 was signed into law and commenced upon its enactment on 25th December 2015.

The Act provides the legislative basis for one of National Ports Policy's key recommendations, namely that governance of the five designated Ports of Regional Significance (Wicklow, New Ross, Drogheda, Galway and Dún Laoghaire) should vest in more appropriate local authority led governance structures.

The Act does not prescribe the model of transfer but rather allows for the most appropriate model of governance to be chosen in respect of each individual company.  The two possible models of transfer provided for are:

1. Retention of the existing company structure and transfer of the Ministerial shareholding in the company to the local authority; or

2. Dissolution of the existing company structure and transfer of all assets, liabilities and employees into local authority structures, where the port will be administered as a functional area of the local authority.

The local authorities concerned have commenced a due diligence process with the ports due to be transferred. My Department has provided some funding towards the process and continues to liaise with local authorities and ports with regard to facilitating the transfer process and the model of transfer.

With regard to funding for ports, National Ports Policy clearly outlines that commercial port companies must operate on a commercial basis without recourse to State funding for dredging or infrastructure development.  While there is no Exchequer funding provided to ports, ports are encouraged to explore all other avenues of funding available to them.

Following the transfers of the Ports of Regional Significance to local authority control, where a port company transfers under the transfer of shareholding model, the company will continue, as before, to fund all activities, including dredging, from its own resources. In the case of a port company that is dissolved and transferred directly under a local authority, it will continue to generate income from port activities under the local authority.

In relation to Dún Laoghaire Harbour Company, Dún Laoghaire-Rathdown County Council has procured consultants to conduct the due diligence of the company as part of the planned transfer of the company to the Council.  This exercise is intended to assist in the decision as to the most suitable model of transfer.  The procurement and management of the due diligence process is a matter for the Council, and I understand that the process is now well advanced. In addition, Dún Laoghaire Harbour Company and Dún Laoghaire-Rathdown County Council have established two transitional teams which are working on the practical issues associated with the transfer.

Maintenance of the runway at Shannon Airport is an operational matter for Shannon Airport Authority (SAA) which has statutory responsibility for the management and operation of the airport.  As the Deputy will be aware, SAA operates under a commercial mandate and is entirely funded from its own resources with no recourse to the Exchequer.

Plans for the development of the proposed Limerick City Footbridge are the responsibility of Limerick City and County Council.  Provision has been made for this Department to provide grant assistance to the Council and an allocation of €150,000 has been made this year with a view to facilitating the Council in progressing project development. In this context the Council has been asked to provide the supporting documentation required for consideration of the project under the strategic grant scheme category.

The improvement and maintenance of regional and local roads in its area is a statutory function of the relevant road authority in accordance with the provisions of Section 13 of the Roads Act, 1993.  Works on such roads are a matter for the relevant local authority to be funded from its own resources supplemented by State road grants.  The initial selection and prioritisation of projects to be funded from these monies is a matter for each local authority.  My Department has not received any recent application for grant assistance relating to a Douglas East-West Link.

Given the cutbacks since the financial crisis in State funding for regional and local roads, it has been necessary to curtail the grant programmes for regional and local road improvement schemes and for major realignment schemes in order to protect the funding available for the maintenance of the existing network.

Roads Maintenance

The improvement and maintenance of regional and local roads in its area, including bridges, is a statutory function of each road authority in accordance with the provisions of Section 13 of the Roads Act, 1993.  Works on such roads are a matter for the relevant local authority to be funded from its own resources supplemented by State road grants.  The initial selection and prioritisation of projects to be funded from these monies is a matter for each local authority.  My Department does not, therefore, have the details requested by the Deputy.

My Department did initiate a regional road bridge inspection programme a number of years ago to assess the condition of bridges on the network and this has been followed up with a Bridge Rehabilitation Grant programme.  Under the Bridge Rehabilitation Grant scheme local authorities submit a list of bridges in order of priority for consideration for funding.  Within the constraints of the overall roads budget, allocations are made to local authorities for remedial bridge works.  The allocations and payments for each local authority are available in the regional and local road allocation and payment booklets in the Dáil library.

As regards bridges on national roads, these are managed by Transport Infrastructure Ireland (TII) in conjunction with the relevant local authority and I have referred the Deputy's question to TII for direct reply.  Please advise my private office if you don't receive a reply within 10 days.

The Regional Airports Programme that is administered by my Department supports the four regional airports in Donegal, Ireland West Airport Knock (IWAK), Kerry and Waterford with implementing necessary safety and security related projects, including measures in these two areas that are requisite to comply with regulatory requirements.

Over the past five years, Waterford Airport has received €9.6 million in operational and investment support from my Department and in April of this year, a further €157,500 in grant aid was approved for a number of security projects, including new X-Ray equipment, at the airport.

The extra €10 million in capital funding that is provided in the Programme for Government, which is additional to the €28 million already provided for in the Capital Plan 2016 to 2022, will enhance my Department's ability to further support the four airports, including Waterford Airport in these important areas. The allocation of that funding has yet to be decided.

Development projects which are designed to expand capacity are a commercial matter for the airports themselves.  In the case of the proposed runway extension at Waterford, I understand the airport authorities are pursuing local interests for funding in relation to that project.
