40. Deputy Pearse Doherty asked the Tánaiste and Minister for Justice and Equality if the Mortgages Special Court Bill / Courts (Mortgage Arrears) Bill is intended to implement the programme for Government commitment to establish a dedicated new court to sensitively and expeditiously handle mortgage arrears and other personal insolvency cases; the reason the Bill is listed in the legislative programme as currently under consideration rather than as in preparation; and if she will make a statement on the matter. I can confirm to the Deputy that the purpose of this Bill reflects the relevant Programme for Government commitments in this area.

The Deputy will appreciate that proper consideration has to be given to the extent to which legislative measures are required to give effect to these purposes, and that the Heads of the Bill in question will also be subject to legal advice. The wording of the current legislative programme reflects this, and will, of course, be updated as preparatory work progresses.
