Basic Payment Scheme Payments

701. Deputy Michael Healy-Rae asked the Minister for Agriculture, Food and the Marine the status of a payment to a person (details supplied) under the basic payment scheme; and if he will make a statement on the matter. [23478/16]

An application under the 2015 Basic Payment/Areas of Natural Constraint Scheme was received from the person named on 18 May 2015. While the holding of the person named was subject to a Remote Sensing inspection this did not result in any area reductions being applied to the payment due under the 2015 Basic Payment Scheme. Payments due under this scheme issued to the bank account of the person named on 10 November 2015, 1 December 2016 and 24 June 2016.

Following processing it was identified that the holding of the person named did not meet the ANC eligibility requirements as outlined in the Terms and Conditions of the scheme. The person named unsuccessfully appealed this decision to my Department. A subsequent appeal is currently being considered by the Agriculture Appeals Office. The person named will be directly notified of the outcome of this appeal as soon as a decision is reached.

Sheep Technology Adoption Programme Applications

In order to qualify for payment under the 2015 Sheep Technology Adoption Programme participants were required to attend five meetings and satisfactorily complete two tasks. In the absence of confirmation of satisfactory completion of these requirements payment did not issue in this case. However following a review of the case including confirmation of completion of the required tasks payment will now issue directly to the nominated bank account of the person named.

An application under Tranche 1 of GLAS was received in my Department on 16 May 2015 and the person named was approved into GLAS 1 with effect from 1 October 2015.

Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue.

The application of the person named has successfully completed the latest GLAS pre-payment validation checks in respect of the 2015 scheme year. Subject to the application passing the remaining checks currently being carried out the 2015 part-year payment for the person named will be sent for payment shortly.

The person named submitted a 2015 Basic Payment Scheme/Areas of Natural Constraint Scheme application on 29 April 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Ground Eligibility inspections, be completed before any payments issue.

The application of the person named was selected for a Ground Eligibility inspection. This inspection resulted in findings of an over-declaration in area of between 3% and 20%. The person named was notified of the inspection decision on 16 November 2015.

The person named sought a review of this decision. As part of the review process a further inspection was undertaken and this inspection increased the eligible area in respect of one parcel. This resulted in the payment due to the person named under the 2015 Basic Payment Scheme being recalculated and outstanding monies due issued in May 2016. The remaining ineligible areas are currently being reviewed and a decision on the outcome will issue shortly.

In the event that the person named is dissatisfied with the outcome of this review the decision can be appealed to the independent Agriculture Appeals Office, within 3 months.

Payment due under STAP issued to the person named on the 19 April 2016.

The person named has been approved under Tranche 1 of GLAS with a contract start date of 1 October 2015. GLAS applicants with a start date of 1 October 2015 are entitled to a 2015 part-year payment in respect of 2015 eligible actions, covering the three month period 1 October 2015 - 31 December 2015.

My Department received a request to withdraw a parcel approved for the Low Input Permanent Pasture action from the approved GLAS application and this has delayed the processing of the payment. In light of the changed situation the application must be re-assessed and payment will issue when this re-assessment is complete.

The person named was notified on 18 January 2016 that as he had not satisfactorily completed the two tasks and had not attended the required number of meetings, payment was not due. The person named was also notified of the option to appeal this decision. There is no record of any such appeal in my Department.

My Department has no record of receiving an AEOS application for the person named.

However an application under Tranche 1 of GLAS was received in my Department on the 20 May 2015 and the person named was approved into GLAS 1 with effect from 1 October 2015.

The application of the person named was selected for an inspection. Once the inspection process is finalised the processing of 2015 payment will be completed.

The Agriculture Appeals Office has confirmed that an appeal was received from the person named and has been assigned to an Appeals Officer. An oral hearing has been arranged for Friday 22nd July 2016 as requested by the appellant. Following the oral hearing the case will be fully considered by the Appeals Officer and a comprehensive decision letter will issue in writing to the person named.

An application for Tranche 2 of the GLAS Scheme was received in this case on the dedicated GLAS online system on 29 November 2015.

The pre-approval validation checks on the application of the person named found that the Low Input Permanent Pasture (part parcel) and Traditional Hay Meadow (part parcel) actions were not in accordance with scheme specifications and were therefore excluded as valid actions from the application.

The application was ranked as a Tier 3 application, scoring 7.50 which was below the minimum required pass mark of 16.50 and it was therefore unsuccessful for admission to the scheme. A letter issued to the person named on 10 March 2016 notifying them of this decision and giving an option of appeal to the GLAS Section.

An appeal has been received from the Agricultural Advisor of the person named and is currently being processed by my Department. The person named will be notified in writing of the outcome of this appeal once a decision has been made.
