Rent Supplement Scheme Eligibility

89. Deputy Róisín Shortall asked the Minister for Social Protection if he will address the serious anomaly for lone parents in receipt of maintenance payments and also rent supplement in that they receive no benefit from maintenance payments due to the means test rules operating for rent supplement; if his attention has been drawn to the fact that in some cases a parent in these circumstances may suffer a net loss due to receiving maintenance payments; and the way he will address this issue. Rent supplement plays a vital role in housing families and individuals, with the scheme currently supporting some 50,700 recipients for which the Government has provided €267 million for in 2016.

Rent supplement is a statutory means tested scheme which is payable at differentiated rates of payment taking into account the applicant's means and their family's accommodation requirements. Rent supplement is normally calculated to ensure that a person, after the payment of rent, has an income equal to the rate of supplementary welfare allowance (SWA) appropriate to their family circumstances less a weekly minimum contribution which recipients are required to pay from their own resources. The weekly minimum contribution is €30 for a single adult household and €40 for coupled households. Many recipients pay more than this amount because recipients are also required, subject to income disregards, to contribute any additional assessable means that they have over and above the appropriate SWA rate towards their accommodation costs.

For rent supplement, maintenance payments of up to €95.23 per week are assessed in determining the appropriate rate payable. Where a person has weekly maintenance payments of more than €95.23, the first €75 a week together with 25% of any additional maintenance above €75 can be disregarded for means assessment purposes. Any changes to the conditions of the rent supplement scheme can only be considered in a budgetary context.

The Department's overall strategic policy direction is to return rent supplement to its original purpose, short-term income support, by transferring responsibility for persons with long-term housing needs to the local authorities under the Housing Assistance Payment (HAP).

Deputy Anne Rabbitte asked the Minister for Social Protection his views on a decision that six contract meter readers, CMRs were employed under a contract of service, that is that their employment was insurable under the Social Welfare Acts PRSI class A, subject to earnings requirements rather than class S which is the class that has been applied to them since 1994 (details supplied); and if he will make a statement on the matter. Scope section in the Department of Social Protection makes statutory decisions on insurability of employment under the Social Welfare Act. Employers, employees and the self-employed may apply to Scope for an investigation of an employment status and a determination of the correct class of PRSI. Scope decisions are based on all available evidence, including a report from a social welfare inspector where appropriate, and the case law from previous court judgements.

A number of test cases in relation to the Electricity Supply Board (ESB) Contract Meter Readers were investigated by Scope. It was determined by Scope that the work of ESB Contract Meter Readers was insurable at PRSI Class S from 1 September 2009.

These decisions, including the case referred to by the Deputy, have been appealed to the Social Welfare Appeals Office. The Office operates independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions of Scope section.

State Pension (Non-Contributory) Eligibility

Durkan asked the Minister for Social Protection if and when a non-contributory old age pension will issue to a person (details supplied) whose application was submitted in July 2016 and in respect of whom the relevant social protection office has already visited and made preliminary assessment; and if he will make a statement on the matter. Entitlement to State Pension non-contributory is subject to a means test. Items which count as means include cash income, including foreign pensions, the value of any property (excluding a person's own home) and the value of any savings and investments which a person may have.

All the necessary enquiries are almost finalised in this case and the person concerned will be notified of the outcome very shortly.

Carer's Allowance Appeals

93. Deputy Kevin O'Keeffe asked the Minister for Social Protection if he will consider backdating a specific allowance in respect of a person (details supplied). [32340/16]

Carer's Allowance (CA) is a social assistance payment made to persons who are providing full-time care and attention to a relevant person/persons and whose income falls below certain limits.

The person concerned is currently in receipt of CA in respect of two care recipients, for whom she also receives domiciliary care allowance (DCA).

Her earliest application for CA was awarded from 5 June 2014.

The person concerned appealed the date from which she was awarded DCA. An appeals officer, having fully considered all of the available evidence has allowed that appeal.

The person concerned has requested on 10 October 2016 that her carer's allowance be backdated to the same date as the DCA. That request is currently being processed and once completed she will be notified directly of the outcome.

Personal Public Service Numbers

94. Deputy Martin Ferris asked the Minister for Social Protection if he will resolve an issue in the case of a person (details supplied) who cannot enrol in a school without a personal public service number, PPSN. [32341/16]

The requirements for the allocation of a Personal Public Service (PPS) Number are acceptable evidence of identity, evidence as to why a PPS Number is required, and evidence of address. In addition, for persons under 16 years of age, evidence of the relationship between the child and responsible adult must be presented.

In this case, no evidence of the requirement for the PPS Number or evidence of address was provided when the person presented at the office on 29 September. The person's father, who accompanied him, was advised of these requirements, was advised that the application could not proceed until this information was received and was given an addressed envelope to return the evidences required to the officer. The father stated that he would return on 6 October with the information, but to date it has not been provided.
