Social and Affordable Housing

482. Deputy Brian Stanley asked the Minister for Housing, Planning, Community and Local Government his plans to introduce legislation to allow tenants of approved housing bodies to buy their homes as per a scheme similar to the one that is available to local authority tenants. [41658/16]

Under the terms of the various funding schemes supporting the delivery of social housing by approved housing bodies (AHBs), AHBs are the de facto owners of the properties concerned and are required to make them available for social renting for the duration of the mortgage or, as the case may be, the availability agreement. My Department cannot unilaterally make provision for their sale to tenants. Any such decision would have to involve the AHB and have regard to the mortgage on the property. On expiry of the mortgage period and subject to compliance with the terms of the funding agreement, the AHB becomes the owner of the property.

Section 45 of the Housing (Miscellaneous Provisions) Act 2009 does provide for the sale by housing authorities and AHBs of designated new houses to eligible households, subject to specified terms and conditions. However, any such sales would have to be progressed by the AHBs. There are currently no proposals or plans for a tenant purchase scheme in relation to AHB houses.

Social and Affordable Housing

I was very pleased to have been in a position to announce Stage 1 funding approval of €17,859,976 for Dublin City Council to progress the delivery of 56 Social Housing dwellings at the former O'Devaney Gardens. These dwellings benefit from an existing approval under the Planning Acts for 110 social and affordable units on a portion of the site.

This is the first phase of a mixed tenure re-development of the entire site to deliver approximately 600 dwellings in total with a mix of 30% social, 20% affordable and 50% private housing.

I understand that Dublin City Council intend that the remainder of the lands will be developed jointly with a private developer under a development agreement, to deliver a total of approximately 300 private, 120 affordable and the remaining 124 social dwellings to achieve the 600 dwellings at the agreed tenure ratio for the site.

Traveller Accommodation

Deputy Dessie Ellis asked the Minister for Housing, Planning, Community and Local Government the number of Traveller families on the waiting list under the local authority Traveller accommodation programmes 2014-2018, by local authority, in tabular form; the current budget spend on the local authority Traveller accommodation programmes 2014-2018, in tabular form; the details of the housing stock each local authority has provided up to 2016 and plans to be built before the end of the local authority Traveller accommodation programmes; if any local authority has not used its full monetary allocation for the programmes; and if not, the amount that was returned for each year from 2013. In accordance with the Housing (Traveller Accommodation) Act 1998, housing authorities have statutory responsibility for the assessment of the accommodation needs of Travellers and the preparation, adoption and implementation of multi-annual Traveller Accommodation Programmes (TAPs) in their areas. My Department's role is to ensure that there are adequate structures and supports in place to assist the authorities in providing such accommodation, including a national framework of policy, legislation and funding.

The first three TAPs covered the periods 2000-2004, 2005-2008 and 2009-2013. Local authorities adopted the fourth and current round of TAPs in April 2014, with the five-year rolling programmes running from 2014 to 2018. These programmes provide a road map for local authority investment priorities over the period. They also form the basis for the allocation of funding from my Department for Traveller accommodation. Local authorities submit proposals for individual Traveller-specific projects and developments which are assessed on a case-by-case basis in my Department, in advance of allocations being made.

The number of traveller families on the waiting list under the local authority traveller accommodation programmes 2014-2018 and the allocation of housing is a matter for each individual local authority, the details of which are not held in my Department.

The allocations and recoupment profiles for capital Traveller accommodation projects can vary across local authorities given the local priorities, circumstances and project timelines as set out in the TAPs. Funding is recouped to local authorities on eligible expenditure incurred and, where it is likely that an allocation to a local authority may be unspent or under-spent, my Department engages with local authorities to re-allocate the funding in order to ensure that drawdown is maximised. The allocations and recoupment to date in relation to the current local authority traveller accommodation programmes 2014-2018 and also for 2013, as requested, are set out in tabular form in the table at Appendix 1.

Details of targets under the Traveller Accommodation Programmes and outputs achieved for the years 2014 and 2015 are attached at Appendix 2. Details of 2016 outputs are being compiled.

Lead responsibility for the maintenance of sustainable communities on the off-shore islands rests with the Minister for Arts, Heritage, Regional, Rural and Gaeltacht Affairs, whose Department works with other bodies, including my Department, in meeting its objectives in this area.

The overall strategic objective of Government housing policy is to enable all households to access good quality housing appropriate to their household circumstances and in sustainable communities of their choice. The Government’s vision for the housing sector is being implemented through Rebuilding Ireland – An Action Plan for Housing and Homelessness published in July 2016. The aim is to significantly increase housing delivery, including a social housing programme of 47,000 units to be delivered by 2021. The accelerated delivery to be provided through this programme will contribute to one of the core objectives of the Plan, namely to deliver housing in a way that meets current needs while contributing to wider objectives such as the need to support sustainable urban and rural development and communities.

The results of the 2016 Summary of Social Housing Assessments were published in December 2016 and provide details on the number of households qualified for social housing support across each local authority. The Summary results will be used to inform the social housing targets to be set on a county by county basis over the period of the Action Plan. Decisions relating to the location of social housing units within an authority’s administrative area are a matter for the authority concerned, by reference to national and local planning and housing policy.

Local Government Reform

Deputy Éamon Ó Cuív asked the Minister for Housing, Planning, Community and Local Government the process that will be involved in implementing the proposals to amalgamate Galway city and county councils in one new authority; if there will be a plebiscite in the county as a whole on this matter; if legislation will be required to implement this decision; if his attention has been drawn to the fact that the elected members of Galway County Council passed a resolution rejecting the proposal; and if he will make a statement on the matter. An Expert Group was established recently to carry out further detailed examination and planning arising from the report of the Galway Local Government Committee in relation to future local government arrangements in Galway. That report recommended the establishment of such a Group to undertake a detailed technical review by way of follow up to its proposals.

The Group has been asked to provide an initial report on these matters by 31 March 2017, which will be considered in the context of an overall report on local government matters to be submitted to Government and the Oireachtas by mid-2017 under the Programme for a Partnership Government.

I am aware of the resolution by Galway County Council concerning the 2015 committee’s report. Primary legislation would be necessary in the event of a decision to implement the recommendation in the report that a new unified Greater Galway Authority be established. There is no requirement for the holding of a plebiscite on such a matter.

National Planning Framework

The National Planning Framework will act as the strategic planning context for relevant Government policies and investment in housing, water services, transport, communications, energy, health and education infrastructure, as well as the preparation by the three new Regional Assemblies of their new regional spatial and economic strategies, and for planning authorities and An Bord Pleanála. In this context, I have already engaged in successful preliminary consultations with key stakeholders, including with colleagues in other Departments and agencies, in order to inform the Framework, in recognition of the whole-of-Government approach and the challenges and opportunities that exist to better align place making, investment priorities, employment and environmental strategies.

Later this month, I intend to launch the initial public consultation phase on the framework. This will provide all citizens, stakeholders and bodies with an opportunity to have their say on how Ireland should develop over the next twenty years or more. This consultation phase will run until mid-March. Following this and having regard to the views and submissions received, I expect that a draft National Planning Framework document will be available for full consultation by the Summer to enable further discussion and opportunities for input, prior to finalisation later in 2017.

Deputy Dara Calleary asked the Minister for Housing, Planning, Community and Local Government his views on the national planning framework as outlined to the media during December 2016, the reason he envisages that no area north of County Galway will be earmarked for targeted development similar to his proposals for counties Cork, Waterford, Limerick and Galway; his further views on the flaws of this exclusionary approach; if this is agreed government policy; and if he will make a statement on the matter. I intend to launch a preliminary public consultation process later this month, and running until mid-March, to inform the drafting of the new National Planning Framework, a full draft of which will then be published for public consultation before the Summer.

No decision on the detailed content or approach to be contained within the Framework has been taken by me or the Government at this stage. Indeed, I intend that the development of the Framework, one of the most strategically important public policy exercises currently underway by the Government, will be a collaborative exercise whose ultimate success will depend on the degree to which all citizens have the opportunity to have their say on how Ireland should develop over the next twenty years or more, and how we can plan for and accommodate the substantial additional population expected by 2040 in a more strategic and sustainable way.

  Recent media commentary was intended to raise public awareness and stimulate debate on this key strategic policy matter and should not be seen as a firm statement on its content. It will be up to the general public, various public bodies and any other stakeholders to put forward their views to my Department, which is undertaking a number of technical analyses and assessments in support of the development of the Framework. All the relevant matters will then be brought together in the Draft Framework which I intend will address all the relevant strategic territorial planning and regional development issues that our country faces between now and 2040, in relation to rural and urban, as well as terrestrial and marine, elements. In addition to being subject to public consultation, the framework will also be submitted to the Oireachtas for its consideration later this year.

Social and Affordable Housing Eligibility

Deputy Joe Carey asked the Minister for Housing, Planning, Community and Local Government if he will increase the income eligibility threshold for social housing applicants in County Clare from €25,000 to €30,000, in view of the fact that the current limit is well below that set for neighbouring counties; and if he will make a statement on the matter. The Social Housing Assessment Regulations 2011 prescribe maximum net income limits for each housing authority, in different bands according to the area, with income being defined and assessed according to a standard Household Means Policy.

The income bands and the authority area assigned to each band were based on an assessment of the income needed to provide for a household's basic needs plus a comparative analysis of the local rental cost of housing accommodation across the country. The limits also reflect a blanket increase of €5,000 introduced prior to the new system coming into operation, in order to broaden the base from which social housing tenants are drawn and thereby promote sustainable communities.

I am satisfied that the current income limits generally provide for a fair and equitable system of identifying those households unable to provide accommodation from their own resources. These limits will continue to be kept under review by my Department, as part of the broader social housing reform agenda set out in the Social Housing Strategy 2020.

My Department has an agreement with a commercial company for the storage of Departmental records, the costs of which are borne by the Office of Public Works. File delivery and retrieval costs to and from storage are paid for by my Department and amounted to €7,699.87, €3,845.47 and €10,086.25 for 2014, 2015 and 2016, respectively.

Funding is provided to local authorities under my Department’s Social Housing Capital Investment programme, to deliver additional social housing stock through new construction projects and through the acquisition of new and previously owned houses/apartments. There are also a wide range of funding and delivery mechanisms available to local authorities to deliver social housing either directly or in partnership with Approved Housing Bodies. These include current- funded programmes , such as the Rental Accommodation Scheme, Housing Assistance Payment and various leasing arrangements under the Social Housing Current Expenditure Programme.

Details on the number of properties constructed, purchased and leased by all local authorities, including Tipperary County Council, for letting to those on their social housing waiting lists are available on my Department’s website at the following link:

Private Rented Accommodation Evictions

The Planning and Development (Housing) and Residential Tenancies Act 201 6 was signed by the President on 23rd December 2016. It gives effect to a number of commitments related to tenant security contained in Rebuilding Ireland, the Government’s Action Plan for Housing and Homelessness, and in the Strategy for the Rental Sector, which was published in December 2016.

The Act includes measures to prevent a future recurrence of situations where large numbers of residents in a single development are simultaneously served with termination notices to facilitate vacant possession and sale of the property. In this regard, the Act provides that, where a landlord proposes to sell 10 or more units in a development at the same time (i.e. classified as being within a 6-month period), the sales will be conditional on the existing tenants remaining in situ, other than in exceptional circumstances. This will prevent large numbers of tenancy terminations occurring at the same time and the consequent difficulty that tenants would have in finding new accommodation. I signed the commencement order for this measure yesterday and it comes into effect today.

Within the 47,000 social housing units to be delivered under Rebuilding Ireland: An Action Plan for Housing and Homelessness, it is estimated at this stage that approximately 26,000 will be delivered from construction activity while 11,000 will be acquired by local authorities and approved housing bodies (AHBs) directly from the market or from the Housing Agency, with a portion of these latter units also being newly built. A further 10,000 units will be leased by local authorities and AHBs.

A breakdown of the approximately 26,000 units to be delivered via construction activity is contained in the table.

Since the launch of the Social Housing Strategy 2020 and continuing with the publication last year of Rebuilding Ireland: An Action Plan for Housing and Homelessness, a substantial pipeline of new social housing construction projects has now been created that has reversed the position of previous years, when local authorities and AHBs had seen much reduced activity in this area.

All of these projects are now at various stages of advancement in respect of planning, design, construction, etc. This work by local authorities and AHBs runs in parallel with the 4-stage approval process; updated details of the stage of individual projects within the approval process will be finalised and published in conjunction with the Q4 2016 Rebuilding Ireland progress report. I am keen that all of the projects involved are advanced as quickly as possible and I have assured the local authorities that funding is available to fully support their efforts in this regard.

On completion of units through whatever delivery means, their final tenanting is then a matter for the local authorities directly. However, I am keen that in all cases there should be no undue delay between the completion of units and completion of the tenanting process.

The numbers of full time equivalent (FTE) civil service workers in my Department for the start of each of the years 2007 to 2015, broken down by the income bands requested, are set out in the table.

There was a significant change in the staffing levels in the Department from 2011 to 2012; this is a result of structural changes that occurred in May 2011 with the transfer of the heritage function to the Department of Arts, Heritage and the Gaeltacht and the transfer of community functions to my Department. In July 2016, the Department was reconfigured further with the transfer of 52.3 FTEs in the environment function to the Department of Communications, Climate Action and Environment and 38.35 FTEs in the rural development area to the Department of Arts, Heritage, Regional, Rural and Gaeltacht Affairs.

The folio of lands referred to is in the ownership of the Housing Agency. The lands were purchased by the National Building Agency approximately 10 years ago and in the course of winding up the National Building Agency, this asset transferred to the Housing Agency.

Under the Tipperary South County Development Plan 2009 – 2015, the land is zoned open space, and I understand that there has been no new plan since 2015 and that a countywide development plan has yet to be completed. If the disposal of a site were to be considered, the approval of the Board of the Housing Agency would be required, before Ministerial approval is sought for the disposal. I understand from the Housing Agency that, to date, no representation has been made to the Housing Agency by the school board of management to purchase the site.
