76. Deputy Michael McGrath asked the Minister for Finance further to the regulatory breaches that led to the Central Bank’s recent fine of €2.275 million against a bank (details supplied), if specific breaches have been referred to An Garda Síochána; and if he will make a statement on the matter. The Central Bank has various reporting obligations in circumstances where the information obtained by it at any stage prior to, during, or after an Investigation, gives rise to a suspicion of a criminal offence, a breach of company law, or a breach of competition law. In such circumstances, the Central Bank has an obligation to refer the matter to the relevant authority, as prescribed under Section 33AK(3) of the Central Bank Act 1942, as amended. Relevant authorities include An Garda Síochána, the Revenue Commissioners, the Director of Corporate Enforcement, the Competition Authority, and the National Consumer Agency.

I am awaiting an update from the Central Bank on the case referred to here and I will let the Deputy know the outcome of this as soon as is appropriate.
