Deputy Éamon Ó Cuív asked the Minister for Social Protection the reason a decision has not been made in respect of a disability allowance appeal lodged by a person (details supplied) in view of the fact that the appeal was lodged on 9 February 2017; the reason for the delay in making a decision on this application; and if she will make a statement on the matter. I propose to take Questions Nos. 1479 and 1491 together.

The Social Welfare Appeals Office has advised me that the appeal from the person concerned was referred to an Appeals Officer who has decided to hold an oral hearing in this case on 31 August 2017. The person concerned will shortly be notified of the arrangements for the hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

I hope this clarifies the matter for the Deputy.
