492. Deputy Éamon Ó Cuív asked the Minister for Communications, Climate Action and Environment if he has received advice in relation to the illegal dumping in the 16th-century old dock in Galway; the steps that he plans to take to deal with this matter; and if he will make a statement on the matter. My role, as Minister, is to provide the legislative and policy framework under which both local authority and Environmental Protection Agency, EPA, enforcement action against illegal dumping is initiated.

Enforcement action against illegal waste activity is a matter for the local authorities and the Office of Environmental Enforcement within the EPA. Under section 60(3) of the Waste Management Act 1996, as Minister, I am precluded from exercising any power of control in relation to the performance by the EPA or a local authority, in particular circumstances, of a statutory function vested in it, including enforcement functions.
