Departmental Agencies Funding

Deputy Dara Calleary asked the Minister for Agriculture, Food and the Marine the steps he has taken to ensure that grant aided organisations are spending their moneys appropriately in view of the revelations regarding a charity (details supplied) in 2016; if his attention has been drawn to concerns in relation to organisations funded by his Department; if so, the action he has taken; if his Department has issued new procedures regarding the use of credit cards; and if he will make a statement on the matter. I wish to inform the Deputy that all funding is provided by my Department on condition that it is used for the specific purpose intended and that there is compliance with the Statement of Principles as set out in the Department of Public Expenditure and Reform Circular 13/2014: Management and of Accountability for Grants from Exchequer Funds, and/or is subject to the Department’s appropriate oversight and verification checks of organisations in receipt of grants. 

In relation to seven of the State Bodies under the aegis of my Department, outlined below, which are in receipt of annual funding, my Department is implementing an Oversight and Performance Agreement with the Bodies under which they are required to give assurance of adherence to the terms and conditions of the DPER Circular: 13/2014.

From time to time there have been queries in relation to Animal Welfare organisations in receipt of funding from my Department. These have been followed up, as appropriate, and resolved. All recipients of ex-gratia payments in 2016 were subject to an inspection by Department Veterinary Inspectors and a number of them were audited by my Department's Animal Health and Welfare Division.

My Department does not issue credit cards to any Organisation.

As regards the issuing of credit cards by the State Bodies under the aegis of my Department, this is an operational matter for the State Bodies themselves.  Should the Deputy require any further information from them, my Department has supplied, as requested, details of the dedicated email addresses for State Bodies, to the Clerk of Dáil Éireann, for the information of Oireachtas members.

Agriculture Industry

Smart Farming is a voluntary resource efficiency programme led by the Irish Farmers’ Association, in conjunction with the Environmental Protection Agency. As the Department of Housing, Planning and Local Government (DHPLG) is the parent Department for the EPA any questions on the initiative are within their competence.

The first progress report on the initiative was published on 16th October and is available at the attached link http://smartfarming.ie/wp-content/uploads/2017/10/SFRF.pdf.

The Green, Low-carbon, Agri-environment Scheme (GLAS) provides valuable support to farmers to deliver environmental benefits and public goods which will enhance Ireland's sustainability credentials into the future. It provides support to Irish farmers aimed at enhancing biodiversity, water quality and the mitigation of the future impacts of climate change while allowing Irish farmers to improve their agricultural practices.

There are currently almost 36,600 active participants between GLAS 1 and 2. In addition, almost 13,500 have been approved into GLAS 3.  The targeted level of approvals by end of 2018  of 50,000 farmers as set out in Ireland's Rural Development Programme was achieved on 1 January 2017.

The average GLAS basic contract payment for GLAS 1 and GLAS 2 is €4,250 per annum.  The average payment for GLAS 3  will only be available when first payment calculations are fully completed.

Brexit Documents

As Minister for Foreign Affairs and Trade with special responsibility for Brexit, Minister Coveney has responsibility for coordinating the whole-of-Government response to Brexit. In this capacity, he is working closely with his colleagues across Government to address the many challenges resulting from Brexit. This cooperation also involves the relevant State Agencies.

Work at Cabinet level is being prepared through cross-Departmental coordination structures. These represent a frequent and active channel through which all relevant Departments are providing their research, analysis and overall policy input to the Government’s wider response to Brexit, including its priorities for the ongoing Article 50 negotiations between the EU and the UK.

As the outcome of the negotiations is not yet known, an important focus of the planning and preparation being undertaken through these structures is on deepening the Government’s analysis and understanding of the exact consequences of a range of different possible scenarios. This represents an intensification of efforts to build on the Government's contingency planning. 

My Department has conducted a range of analysis and research activities in relation to Brexit. This work is ongoing, and is primarily concerned with the implications of Brexit for agri-food trade with the UK across different sectors.

For example, both internally and in consultation with the relevant stakeholders through the Brexit Stakeholder Consultative Committee and the All-Island Civic Dialogue process, my Department has established the extent of sectoral reliance on the UK market, the potential implications of Brexit for each sector and the possible responses to the challenges presented. It has also been analysing the potential practical impact on the day-to-day functioning of trade flows, as well as potential WTO tariffs that might be applied to Ireland's agri-food exports to the UK in the event of a 'hard' Brexit.

The agencies reporting to my Department have also undertaken important research in relation to Brexit, with Teagasc publishing reports on, for example, the potential implications for the Irish agri-food sector in overall terms and on the implications for family farm incomes, and Bord Bia conducting important work through its Brexit Barometer.

In addition, my Department is in contact with the relevant agencies and with other Departments to co-ordinate further research on the implications of Brexit for the agri-food industry.

GLAS Administration

The target set out in the Rural Development Plan to approve 50,000 GLAS participants before the end of 2018 has already been achieved.

There are no plans to re-open the scheme. My focus now is on ensuring that payments to the 51,000 participants are processed and my Department is working hard to begin making these 2017 advance payments in the coming weeks. The GLAS scheme is one of a suite of many RDP schemes and the re-opening of any scheme can only be considered within the overall RDP budget which is currently fully committed.

To allow us to make the 2017 advance payments, I would again remind the 5,500 participants of GLAS 1 and GLAS 2 who have not yet submitted their nutrient management plan to do so immediately so that their outstanding balancing payment and future GLAS payments, including the 2017 advance payment, can issue.

Livestock Issues

The intra EU movement of animals is recorded on the Trade Control and Expert System (TRACES), which is the EU-wide online management tool for all sanitary requirements on intra-EU trade and importation of animals, semen and embryo, food, feed and plants. Movements are recorded at the level of Member State only on TRACES.

According to TRACES 388,671 sheep have been imported into the State from other EU member states up to 1st November this year, of which 388,517 were from the United Kingdom. The vast majority of these would have been imported directly from Northern Ireland.

In addition to the recording of movements of animals the importation of bovine livestock between Ireland and other EU jurisdictions, is governed by EU Council Directive 91/68 EC on animal health conditions. 

My Department and its officials take very seriously, from both a traceability and food safety perspective the movement of livestock, including sheep, into the state. If the Deputy has any specific examples of the illegal movement of lambs into the state, he should bring these examples to the attention of my Department and An Garda Síochána.

Ministerial Meetings

Hazardous Substances Regulation

As you will be aware the Commission prepared a first draft of a proposal for renewal of the approval of glyphosate and this was discussed by Member State representatives at the technical experts standing committee meeting in July and again in early October.

The draft Commission proposal tabled at these meetings was to renew the approval of glyphosate for a 10-year period, instead of the normal 15-year period but also attaching various additional conditions of use. The Commission proposal to renew glyphosate is based on the conclusions of risk and hazard assessments conducted by the European Food Safety Authority and the European Chemicals Agency.

As a number of Member States had not committed to a voting position at the early October meeting, a further meeting was convened on 25 October last.  At this meeting it was evident that there was insufficient support for the EU Commission proposal and consequently no vote was taken.  There followed a brief discussion which largely concentrated on the length of the approval period but this discussion failed to yield a satisfactory compromise. 

A further meeting of the standing committee is scheduled for 9 November. A revised proposal to renew the approval of glyphosate for a 5-year period has been tabled by the EU Commission for discussion at this meeting.

My Department indicated support for the Commission proposal (10-year approval) tabled at the 25 October meeting.  My Department is currently considering the revised Commission proposal and a position will be taken in advance of any vote.

Transfer of Entitlements Application

The persons named submitted three 2017 Transfer of Entitlements applications to my Department, one by way of inheritance and two by way of gift.  These transfer applications have been finalised and notification  has been issued by my Department directly to the persons named.

Agri-Environment Options Scheme Appeals

The person named joined the AEOS3 scheme with a start date of 1 May 2013. He received payments in respect of the 2013, 2014 and 2015 scheme years. An AEOS inspection was carried out on 27 July 2016 and he was informed by letter dated 9 November 2016 that, as a result of the findings of that inspection, he was rejected from the scheme and was given the option of requesting a review by the Regional Inspector.

A review request was received and dealt with by the Regional Inspector, who upheld the decision of the inspector in a letter to the person named, dated 28 August 2017 giving the person named a right of appeal to the independent Agricultural Appeals Office.

It is understood that an appeal was submitted to the Agriculture Appeals Office. A decision will issue from that office to the person named in due course.

TAMS Administration

A budget of €395m is available under TAMS II for a suite of seven measures covering a wide range of investments including energy efficient measures under the existing Pig and Poultry Investment Scheme.

Over 9,000 farmers have an existing approval in place across the TAMS measures for which no payment claim has yet been submitted.

Until these approvals are acted upon and the budgetary position is clearer, it is not intended to amend the list of investments or increase the existing ceiling.

Sheep Welfare Scheme

The Sheep Welfare Scheme was introduced in December 2016 to support the delivery of flock health benefits in the sheep sector.  Under the terms and conditions of the scheme, applicants to the scheme are required to submit the annual Sheep Census return within the required deadlines.  In the case of this application, the Sheep Census return for 2016 was not received within the required deadlines and thus the application for participation in the scheme was not accepted.

The applicants submitted an initial appeal on this decision to the Department.  However, this appeal was unsuccessful.  The applicants have been advised that they have the option to seek a review of this decision to a higher officer of the Department. There is also a subsequent right of appeal to the Agriculture Appeals Office.

Departmental Contracts Data

I wish to inform the Deputy that my Department has or had the following contracts with the company referenced in the question.

A contract valid from 1 September 2014 – 31 August 2018 for the provision of a service for the registration of bovine births, the issuing of bovine passports and the handling and processing of notifications in relation to farm to farm bovine movements and on-farm bovine deaths. The total value of this contract is approximately €20 million. A new public procurement competition (Request For Tenders) will be advertised for this service in 2018, well in advance of the expiry date of the existing contract and should be in place for 1st September 2018

A contract valid from 1 March 2014 – 28 February 2016, for the provision of a service for the handling, processing, verification and recording of pig movement notifications. The value of this contract was €320,000.  A further contract, for the same service is in place, valid from  1st March 2016 to 28th February 2018. The total value of this contract is €320,000. It is anticipated that the need for the pig contract will continue post February 2018 and we are currently in the process of drafting an RFT for publication on e-tenders, in order to have a further contract in place by 1st March 2018.

GLAS Payments

The person named was approved into GLAS 1 with a contract commencement date of 1 October 2015 and has received all payments in respect of 2015.

During the processing of the 2016 balance payment an issue presented on the computerised crosscheck of Department databases. Department officials are actively working to resolve this issue with a view to releasing the outstanding payment as soon as possible.

Forestry Sector

Deputy Tom Neville asked the Minister for Agriculture, Food and the Marine the recourse available to a person that is not in a financial position to replant forestry after it was cut; if the time permitted to replant the forestry can be extended; and if he will make a statement on the matter. The Forestry Act 2014 sets out the legislation governing the felling of trees, the licences required, offences and penalties for breaches of the legislation. My Department operates policy and procedures in relation to tree felling which are underpinned by the provisions of the Act.

In May 2017 my Department published its “Felling and Reforestation Policy” document which aims to provide a consolidated source of information on the legal and regulatory framework relating to tree felling. Information on the felling licence application process is also described. This document also describes those limited scenarios where the permanent removal of trees is envisaged, for example for the protection of certain natural habitats and species.

With regard to extending the deadline on the replanting obligation these requests are considered by my Department on a case by case basis.

Aquaculture Licence Applications

Deputy Tom Neville asked the Minister for Agriculture, Food and the Marine when an aquaculture licence application by a person (details supplied) in County Kerry will be processed; if a derogation will be given to the person until their application is processed; and if he will make a statement on the matter. The application for an aquaculture licence referred to by the Deputy is in respect of a site located in Castlemaine Harbour, which is designated as a Special Area of Conservation under the EU Habitats Directive and a Special Protection Area under the EU Birds Directive (Natura 2000 site).

All applications in ‘Natura’ areas are required to be appropriately assessed for the purpose of environmental compliance with the EU Birds and Habitats Directives. The Appropriate Assessment of Castlemaine Harbour has been completed and the relevant licensing determinations have been made based on applications to hand at the time of the assessment.

The specific application referred by the Deputy was submitted to my Department subsequent to the carrying out of the Appropriate Assessment process for this harbour. Accordingly, it was not possible to assess this application against the designated Conservation Objectives for the harbour.

The optimum method for appropriately assessing applications by individual operators, who were not included in the initial overall assessment procedure, is under active consideration by my Department. The process must comply with best scientific practice and be achieved in a manner which will be acceptable to the national authorities and to the EU Commission.

In the meantime, the assessment procedures agreed with the EU Commission require Appropriate Assessments in respect of aquaculture activities to be carried out by the national authorities and unilateral departure from these arrangements is not possible.

Every effort is being made to expedite the conclusion of this matter as soon as possible.

There is no provision in the legislation governing aquaculture for a derogation from the licensing requirement. Section 4 of the Fisheries and Foreshore (Amendment) Act 1998 prohibits an applicant or any person on behalf of the applicant to engage in aquaculture at the place or waters to which the application relates before a licence is granted under the Fisheries (Amendment) Act 1997.
