1487. Deputy Darragh O'Brien asked the Minister for Children and Youth Affairs if access will be provided for preschools registered with her Department and that operate the early childhood care and education scheme to the State indemnity operated by the National Treasury Management Agency; and if she will make a statement on the matter. As I previously informed the Deputy, the State indemnity is operated by the National Treasury Management Agency who acts as the State Claims Agency. All Department's claims are delegated for management to this agency.  This State indemnity also extends to bodies under the aegis of the Department which include the Adoption Authority of Ireland, the Children Detention Schools, the Child and Family Agency/Tusla and the Ombudsman for Children's office.

The Early Childhood Care and Education scheme is a scheme operated mainly by private childcare services. It is not possible to extend the State’s indemnity to such businesses which have access to the insurance market. For this to occur all of these facilities would require to be designated as a State Authority.
