Deputy Róisín Shortall asked the Minister for Justice and Equality the number of court appeal applications which have been made by lending institutions in repossession cases in which the case has been dismissed or struck out; and the procedure used for such applications for appeals to the court system. Amharc ar fhreagraAs the Deputy will be aware, under the provisions of the Courts Service Act 1998, management of the courts is the responsibility of the Courts Service, which is independent in exercising its functions.
However, in order to be of assistance to the Deputy, I have had enquiries made and the Courts Service has informed me that court statistics are not compiled in such a way as to provide the information sought by the Deputy. Procedures in relation to the lodging of appeals are set out in Rules of Court. The Deputy may wish to be aware that the Courts Service is precluded from offering legal advice.
