Ceist:

1901. Deputy Pat The Cope Gallagher asked the Minister for Agriculture, Food and the Marine if the State is liable for all costs for the legal challenges and the cases against his Department in relation to SI No. 3 of 2014; his plans to release the costs incurred as a result of these cases to the State; and if he will make a statement on the matter. I can inform the Deputy that the State was not liable for all the costs for the legal challenges that arose from the operation of the European Communities (Common Fisheries Policy) (Point System) Regulations 2014 (S.I. No. 3 of 2014).  In the O'Sullivan case, the Supreme Court ordered that the plaintiff recover 75% of their High Court costs.

I can also confirm that certain matters pertaining to costs have yet to be finalised in a number of relevant cases. That remains the position. The Deputy will appreciate that it can frequently take some time post the conclusive determination of legal proceedings for matters pertaining to legal costs to be completely finalised.

In relation to S.I. No. 3 of 2014, the following table contains details of cases in respect of which certain costs have been paid to date.  I should advise that certain matters pertaining to costs have yet to be finalised in a number of relevant cases.
