It is the policy of my Department only to engage the services of external consultants where highly specialised skills are not available within the Department and, in particular, when such an approach is more cost effective.

These services are procured by open competitive tendering processes in accordance with EU and national rules and comply with the overall value for money objective of the Department.

Expenditure on the engagement of consultants is paid out of the Departments A7 budget and this year represents around 0.01% of the Health Vote.

The tables in the following link outline the total amount spent on external consultants by my Department from 2012 to 2017.

While some contracts are negotiated on the basis of a daily or hourly rate, others are paid a fee on the basis of reaching of a number of milestones during the process and in some case producing a report.

I propose to take Questions Nos. 1463 and 1885 together.

The Department is aware of the need to minimise costs and in general avails of legal services and advice from the Office of the Attorney General and the Office of the Chief State Solicitor.  My Department has a Legal Unit, staffed by qualified legal professionals who provide advice on a wide range of international legal issues.  Having such "in-house" legal experts reduces the costs which would be incurred if the Department was to engage externally for similar services. However, occasionally specialised legal services are required.

Details requested by the Deputy in relation to amounts paid by the Department for external legal services in relation to drafting of legislation, discovery and advice from 2012 to 2017 are set out in the table below, hourly rates are not available.

Legislative Reviews

1467. Deputy Thomas P. Broughan asked the Minister for Health when there will be a reform of the Mental Health Act 2001; and if he will make a statement on the matter. [33011/18]

An Expert Group Review of the Mental Health Act 2001 was published in 2015.  There are 165 recommendations contained in the review and most of these relate to amendments to the Mental Health Act.  The changes are progressive in nature and first and foremost seek to move away from the often paternalistic interpretation of the existing legislation to one where, insofar as is possible, the individual has the final say in what he/she deems to be in his/her best interests.

Government approval for the preparation of a general scheme of a bill to reflect the recommendations of the review in revised mental health legislation has been received.  Work is ongoing on this comprehensive updating of our mental health legislation and the draft heads are expected to be significantly progressed by end of Q3 2018, at which point consultation with the Mental Health Commission will take place.  It is essential that the Mental Health Commission, which has a very significant and important role in overseeing the safeguards provided in the Act, have full input into the framing of the many amendments to be included in revised mental health legislation.

Since the Expert Review was published two mental health amendment acts have been enacted.  The first was the Mental Health (Amendment) Act 2015 which updated the provisions of the 2001 Act relating to ECT.  The second was the recent enactment of the Mental Health (Amendment) Act 2018 which makes changes to the 2001 Act regarding the definition of voluntary patient and which introduces guiding principles for adults instead of the principle of best interests.  The Act also introduces guiding principles for children and refers to capacity within the meaning of the Assisted Decision-Making (Capacity) Act 2015.

In addition, changes to the 2001 Act will be introduced as part of the new Deprivation of Liberty provisions currently being developed by my Department and also through changes proposed for the Child Care Act 1991.  Finally, there are four other Private Member's Bills published which seek to make changes to the 2001 Act.

The Government is committed to providing services and supports for people with disabilities which will empower them to live independent lives, provide greater independence in accessing the services they choose, and enhance their ability to tailor the supports required to meet their needs and plan their lives. This commitment is outlined in the Programme for Partnership Government, which is guided by two principles: equality of opportunity and improving the quality of life for people with disabilities.

Nursing Staff Remuneration

1470. Deputy Shane Cassells asked the Minister for Health if the qualification allowance paid to public health nurses who hold a children’s nursing degree will be paid to all public health nurses, in all regions, who have attained this qualification. [33032/18]

The HSE circular 112/99 sets out the rules in relation to payment of qualification allowances for nursing and midwifery grades.  Under this circular, a qualification allowance of €2,791 is payable to nurses employed directly on duties in specialist areas with the appropriate qualifications. It also states that a nurse may only benefit from one of the qualifications listed within the Circular when engaged on qualifying duties.

In relation to Public Health Nurses, the circular states that a qualification allowance of €2,791 is payable to Public Health Nurses in respect of their midwifery qualification only.  On that basis, there should be no allowance payable to a public health nurse who holds a children's nursing degree.

I have no role or function in relation to this matter. I understand that Pobal, funded by the Department of Rural and Community Development, provides personal alarms for people over 65 years and older through the Seniors Alert Scheme. No such scheme is in operation for the under 65's.

Hospital Appointments Status

Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual. 

The National Waiting List Management Policy, a standardised approach to managing scheduled care treatment for in-patient, day case and planned procedures, since January 2014, has been developed to ensure that all administrative, managerial and clinical staff follow an agreed national minimum standard for the management and administration of waiting lists for scheduled care. This policy, which has been adopted by the HSE, sets out the processes that hospitals are to implement to manage waiting lists. 

In relation to the particular query raised, as this is a service matter, I have asked the HSE to respond to the Deputy directly.
