586. Deputy Thomas P. Broughan asked the Minister for Housing, Planning and Local Government the referendums he plans to hold in conjunction with the local and European elections in May 2019; the other referendums which the Government plans to hold at a later date and the proposed dates, if decided; and if he will make a statement on the matter. Amharc ar fhreagraAt its meeting last week, the Government reviewed the progress on Bills to amend the Constitution and decided that, subject to passage of the necessary Constitution Amendment Bills, two referendums will be held on the same day as the local and European elections in May 2019. Work is being progressed in my Department, in consultation with the Department of Foreign Affairs and Trade, to inform the development of an appropriate Constitution Amendment Bill in good time for the holding of a referendum on extending the franchise at Presidential elections to Irish citizens resident outside the State. The second referendum to be held in tandem with the local and European elections will be on divorce which will be a matter for the Minister for Justice and Equality.
The Government noted that further consideration will be given to the timing of a referendum on reducing the voting age to 16. However, it is not proposed that this referendum be held in 2019.
In addition, the Government noted all proposals for referendums contained in Private Members’ Bills, in particular the Amendment of the Constitution (Water in Public Ownership) Bill (No.2) 2016 which is now at Committee stage. On 20 November 2018, the Government approved the priority drafting of amendments to be made to this Bill, with work currently on-going. These amendments are to focus on retaining the entity charged with the provision of public water services in public ownership. It is intended that the draft wording arising, once finalised, will be brought back to Government for approval and can then be brought forward as a proposed amendment to the Bill.
587. Deputy Thomas P. Broughan asked the Minister for Housing, Planning and Local Government the details of the public bodies and other entities under the aegis of his Department for which he is responsible for making all or some appointments to which are not subject to the guidelines on appointments to State boards, in that the recruitment and selection process is undertaken by his Department and not through the Public Appointments Service; and if he will make a statement on the matter. Amharc ar fhreagraIn line with a Government Decision of 25 November 2014 and Guidelines put in place by the Department of Public Expenditure and Reform relating to the advertising for expressions of interest in vacancies on State Boards, my Department, in conjunction with the Public Appointments Service (PAS), currently advertises board vacancies as they arise, where I, as Minister, have nominating rights under relevant legislation. I also appoint members on the nomination of various bodies, again in accordance with relevant legislation. Furthermore, certain State Board appointments are executive in nature and are filled on foot of open recruitment competitions.

Broughan asked the Minister for Housing, Planning and Local Government the process for the appointment of a chairperson and lay members to both the professional conduct committee and appeals board of the RIAI under sections 23 and 24 respectively of the Building Control Act 2007; if these appointments are subject to public advertisement such as on State boards or other public means; when the next appointments are due; and if he will make a statement on the matter. Amharc ar fhreagraThe processes for the appointment of members to the Professional Conduct Committee and Appeals Board of the RIAI are laid out in the Building Control Act 2007.
In relation to the Professional Conduct Committee , the Chairperson shall be a solicitor, a barrister or a former judge of the Circuit Court, High Court or Supreme Court who shall be appointed by the Minister for Housing, Planning and Local Government, with the consent of the Minister for Business, Enterprise and Innovation. The Committee includes 6 lay members who are nominated by the Minister for Housing, Planning and Local Government and appointed by the Registration Body.
In relation to the Appeals Board, the Chairperson shall be a solicitor, a barrister or a former judge of the Circuit Court, High Court or Supreme Court who shall be appointed by the Minister for Housing, Planning and Local Government. The Board consists of 3 lay members, two of whom are nominated by the Minister for Housing, Planning and Local Government and one of whom is nominated by the Minister with the consent of the Minister for Business, Enterprise and Innovation, and appointed by the Registration Body.
The RIAI does not receive any funding from my Department and as its Boards are not State bodies under the aegis of the Department, these appointments do not fall within the stateboards.ie process for Board appointments. The next appointments to these committees are due on 10 March, 2019.

Deputy Tom Neville asked the Minister for Housing, Planning and Local Government if the registration of properties will be a registration or licence number for a company (details supplied); and if it will be necessary to provide same to those websites in order to allow them to have the property listed. Amharc ar fhreagraUnder Action 18 of the Strategy for the Rental Sector, a Working Group was established, involving representatives of all major public stakeholders with a policy interest in short-term lettings, to develop guidance in relation to planning applications, changes of use relating to short-term lettings and to examine the need for new regulatory arrangements. Proposals under consideration by the Working Group have been aimed at facilitating short-term letting of accommodation within permanent residences, known as homesharing, while protecting the existing stock of residential property in areas of high demand.
Having considered the Working Group's report as well as the recommendations in the report of the Joint Oireachtas Committee on Housing, Planning and Local Government on short-term lettings, I recently announced plans to introduce a “one host, one home” model in areas where there is high housing demand.
Homesharing will continue to be permissible for a person’s primary residence. In addition, an annual cap of 90 days will apply for the renting out on a short-term basis of a person's entire home where it is their primary residence, with such short-term lets being restricted to periods of 14 days or less at a time. Under these arrangements, people who wish to avail of the new planning exemptions to use their own home for home-sharing or limited short-term letting purposes will be required to register this with their local planning authority.
Where a person owns a second property and intends to let it for short-term letting purposes, they will require planning permission to do so unless it already has planning permission to be used for tourism or short-term letting purposes. Planning permission for a change of use to short-term letting can be sought and it will be up to each local planning authority to consider such applications, based on guidance that will issue from my Department, taking account of housing demand pressures in the area and other relevant factors such as cumulative impacts.
These proposed changes will not affect the operation of holiday homes as typically understood, or longer-term flexible lettings which are provided for those coming to Ireland under employment contracts.
It is intended that the proposed new planning changes will come into effect on 1 June 2019, to allow property owners sufficient lead-in time to prepare for and adapt to the proposed new laws. In addition to the making of revised draft exempted development planning regulations, which are being progressed, amendments to primary legislation will also be introduced which will underpin and strengthen the new proposals. This element of the changes proposed is currently being developed and details will be published in due course.

Deputy Ruth Coppinger asked the Minister for Culture, Heritage and the Gaeltacht if her attention has been drawn to the sale of a building (details supplied) by public auction; the work done to ensure the preservation of this national monument; and if she will make a statement on the matter. Amharc ar fhreagraMy functions, with regard to the protection of our architectural heritage, are set out in the Planning and Development Acts, as are the responsibilities of local authorities and owners.
In relation to the building mentioned by the Deputy, I am aware of the decision by the Office of Public Works (OPW) to dispose of the building. While the sale is a matter for the OPW, and I have no function as Minister, I do understand and appreciate the value such a building would have, particularly to those for whom it has an historic association.
The Planning and Development Acts give primary responsibility to local authorities to identify and protect our architectural heritage by including particular structures on their Record of Protected Structures (RPS). Inclusion on the RPS places a duty of care on the owners and occupiers of protected structures and also gives planning authorities powers to deal with development proposals affecting them and to seek to safeguard their future. As the Deputy may be aware, the building mentioned is not on the RPS. Ultimately, the decision as to inclusion of a building or structure on the RPS remains a reserved function of the planning authority, in this case Dublin City Council.
The primary function of the National Monuments Acts is to record and protect ancient sites and features. The focus of the Acts is on archaeological remains and traces and does not generally extend to more modern buildings and structures. Accordingly, while the Model School is undoubtedly of local interest and importance, it is not included in, nor would it be appropriate for inclusion in, the statutory Record of Monuments and Places maintained by my Department.
591. Deputy Alan Kelly asked the Minister for Culture, Heritage and the Gaeltacht if she will be attending the centenary commemoration of the Soloheadbeg ambush in County Tipperary in January 2019. [50783/18]
Amharc ar fhreagraThe Government's approach to the remembrance of all of those who lost their lives during the Independence Struggle and the significant events and themes associated with this period is informed by the guidance of the Expert Advisory Group on Centenary Commemorations and the core principles set out in the Group's Second Statement, published in October 2017.
My Department has been consulting and collaborating with Tipperary County Council to support the local commemorative committees in their plans for a commemoration to mark the centenary of the Soloheadbeg Ambush, which is generally accepted as the first action in the War of Independence. The matter of official representation at this ceremony is being considered in this context.

Deputy Lisa Chambers asked the Minister for Culture, Heritage and the Gaeltacht if she has formally met with her UK counterpart to discuss Brexit and its impact on east-west trade reciprocal arrangements and all other Brexit related matters that fall within the remit of her Department; the number of times they have formally met to discuss Brexit; and if she will make a statement on the matter. Amharc ar fhreagraThe negotiations on both the EU-UK Withdrawal Agreement and political declaration on the framework for the EU-UK future relationship, both of which we were endorsed by the European Council on 25 November, were conducted on behalf of the EU27 by the EU's Chief negotiator, Michel Barnier, and the Commission's Article 50 Taskforce.
Brexit is a priority issue for this Government, and the Taoiseach, my cabinet colleagues and I have taken every opportunity to engage with EU partners and the UK to advance Ireland’s priorities. Earlier this year as part of my visit to London in connection with the GB 18 Programme in March I met with Matt Hancock MP, the then UK Secretary of State for Digital, Culture, Media and Sport. I also met with Fiona Hyslop MSP, Cabinet Secretary for Culture, Tourism and External Affairs in the course of my visit to Glasgow in February in connection with GB18. At both of these meetings Brexit related matters were discussed in addition to other matters of mutual interest.
The Government has already taken a number of key decisions on measures to support East – West Trade. These include staffing, ICT and infrastructure measures to implement necessary checks and controls at our ports and airports. To support businesses, the Government provided dedicated Brexit support measures in Budgets 2017, 2018 and 2019. Ireland is working closely with the EU and fellow Member States to discuss and to facilitate the use of the UK as a landbridge post Brexit.

Deputy Paul Murphy asked the Minister for Culture, Heritage and the Gaeltacht her views on whether a permanent standalone exhibition to the Great Famine, An Gorta Mór, should be established at the National Museum of Ireland in Collins Barracks; and if she will make a statement on the matter. Amharc ar fhreagraAs Chair of the National Famine Commemoration Committee (NFCC), I am responsible for ensuring that appropriate arrangements are in place to commemorate the Great Irish Famine. This year’s National Famine Commemoration took place on Saturday 12th May in University College Cork, while the International Famine Commemoration was hosted at Williamstown, Melbourne on Sunday 28 October.
While decisions in relation to a permanent exhibition space within a State funded museum in Dublin as part of the State commemoration of the Great Famine would be operational matters for the relevant cultural institutions or other entities concerned, officials in my Department, in consultation with the NFCC, will continue to examine options for further commemorative measures to the tragic events of that era.
