Deputy Catherine Murphy asked the Minister for Finance the status of complaints made under section 172 of the National Asset Management Agency Act 2009; the progress made on same; the conclusions of same; the status of complaints referred to An Garda Síochána under the Act; and if he will make a statement on the matter. Amharc ar fhreagraI am informed by NAMA that two complaints regarding potential breaches of Section 172(3) of the NAMA Act 2009 have been brought to their attention.
In relation to one of the alleged breaches, I am advised that NAMA has concluded its investigations and is satisfied that no breach has occurred. In relation to the second alleged breach, I am advised that An Garda Síochána is separately investigating it and their investigation is ongoing. Criminal investigations, such as this, are a matter for An Garda Síochána and the DPP and I am advised that, to date, their investigations have not resulted in a prosecution.
