175. Deputy Louise O'Reilly asked the Tánaiste and Minister for Enterprise, Trade and Employment the status of the legal right of an employee to a proper consultation process under the Employees (Provision of Information and Consultation) Act 2006 and the Industrial Relations Act 1990 (Code of Practice on Information and Consultation) (Declaration) Order 2008; and the way it applies to the dispute between organisations (details supplied). The Employees (Provision of Information and Consultation) Act, 2006 provides for the establishment of a general framework setting out minimum requirements for the right to information and consultation of employees in undertakings with at least 50 employees. It provides a general right to information and consultation for employees from their employer on matters which directly affect them.

The purpose of the Code of Practice is to assist employers, employees and their representatives to develop effective arrangements for communications and consultation in accordance with the provisions of the above Act.

The legislation applies equally to companies and organisations in the private and State sectors.
