821. Deputy Róisín Shortall asked the Minister for Health if the three-year grace period for a holder of an over 70s medical card following the death of their spouse remains in place; if he can ensure that this information is explicitly stated on the HSE website and information leaflets and not just in the guidance documents; and if he will make a statement on the matter. Eligibility for a Medical Card is determined by the HSE in accordance with the Health Act 1970 (as amended). Surviving persons of medical card holders who satisfied the eligibility criteria in the Health Act 1970 (as amended) for persons aged 70 and over, may retain their medical card for three years following the death of that other person, subject to certain criteria, as set out in the Health Act 1970 (as amended). In relation to the availability and method of communicating medical card information by the HSE, as this is a service matter, I have asked the Health Service Executive to respond to the deputy directly, as soon as possible.
