School Transport

472. Deputy Robert Troy asked the Minister for Education the actions that her Department is taking to deal with cases in which a child has been allocated a seat through the free bus ticket scheme but the child in question is not availing of the seat and there are other students waiting to take up a seat on the same route; and her views on whether in cases in which a ticket is not being used, her Department should have the right to cancel the ticket and allocate a seat to an alternative student. The School Transport Scheme is a significant operation managed by Bus Éireann on behalf of the Department of Education.  In the current school year over 147,900 children, including over 18,000 children with special educational needs, are transported on a daily basis to primary and post-primary schools throughout the country.

In addition, school transport scheme services are being provided in the current school year for over 3,800 children who have arrived to Ireland from Ukraine. 

The total cost of the scheme in 2022 was €332.2m

Under the terms of the Department’s School Transport Scheme, children are eligible for transport where they reside not less than 4.8kms from their nearest Post Primary School as determined by the Department and Bus Éireann, having regard to ethos and language.  

Children who are not eligible for school transport may be considered for transport on a concessionary basis in accordance with the terms of the Post Primary School Transport Scheme and subject to the following conditions:

- an application is made by the deadline date

- there is an existing service in place

- there is spare capacity on the service;

Any remaining seats left after eligible children are accommodated are being allocated to concessionary children in the usual way.  Where the number of applications for transport on a concessionary basis exceeds the number of seats available, Bus Éireann will determine the allocation of the tickets using an agreed selection process. 

It is recognised that all pupils issued with tickets will not travel every morning and every evening.   In addition, certain after school activities may also result in pupils not travelling on certain days.

Bus Éireann organises for vehicles to be full to capacity with tickets based on applications received and based on the seating capacity of the vehicle.   For safety reasons, it is not possible to issue additional tickets over and above the seating capacity of the vehicle which could result in a potential overload situation arising and all pupils not being carried on the service.

If a family decide that they no longer require their bus tickets for the current school year, they should return these tickets to their local Bus Éireann school transport office and their seats will be reallocated to other pupils wishing to avail of school transport. 

At present, it is not possible for Bus Éireann to examine data on ticket usage as tickets are paper based. However, Bus Éireann recently undertook a pilot E-Ticketing project.  Based on the outcome of this pilot project, it is intended that a tender competition for national roll-out of eTicketing on all school transport scheme services will follow.  This will provide the Department and Bus Éireann with greater data on real time travel patterns.

Teaching Qualifications

Deputy Paul Kehoe asked the Minister for Education if she will consider permitting persons with an accredited teaching English as foreign language certificate to substitute as support staff in schools if Garda vetted to fill English as additional language hours and support children with little or no English, given that many English as additional language support roles are unfilled; and if she will make a statement on the matter. Schools must ensure that each person proposed for appointment to a teaching post which is funded by the Oireachtas is registered with the Teaching Council, has qualifications appropriate to the sector, and is suitable to the post for which he/she is to be employed.  All appointments must be subject to compliance with the National Vetting Bureau (Children and Vulnerable Persons) Acts 2012 to 2016 and with relevant Department Circulars in relation to Garda vetting.

Outside limited and exceptional circumstances permitted under Ministerial regulations, an unregistered person employed in place of a teacher in a recognised school cannot be paid from monies provided by the Oireachtas.

The Teaching Council is the professional standards body for the teaching profession, which promotes and regulates professional standards in teaching. The Teaching Council registers teachers under the Teaching Council Acts and in line with the Teaching Council Registration Regulations, 2016. The Council registers teachers under five routes of registration namely, Route 1 - Primary, Route 2 - Post-primary, Route 3 - Further Education, Route 4 - Other and Route 5 - Student Teacher. The minimum registration requirements for each route are set out in the schedule of the Regulations.

While my Department currently does not intend to allow for persons with a teaching English as foreign language certificate to act as support staff in schools, a range of initiatives are being considered to address teacher supply issues. 

My Department is undertaking a comprehensive programme to support the supply of teachers. A number of measures are being implemented to enhance the supply of teachers, including:

- a number of special temporary arrangements are being introduced, following meetings I held with initial teacher education providers, to create greater capacity for student teachers to provided substitute cover.

 

- the Department’s continuing professional development (CPD) services have adjusted planned CPD to reduce the need for substitution and provide additional personnel to support schools

 

- the additional hours that post primary teachers can teach each term have been increased from 20 to 35 for the remainder of the 2022/23 school year.

 

- a communications campaign has been launched to encourage retired teachers to take up short-term substitute positions and enabling them to teach for up to 50 days in each of the calendar years 2021 to 2023 without reducing their pension.

 

- registration with the Teaching Council of over 2,100 3rd and 4th year undergraduate student teachers, enabling them cover substitutable vacancies.

 

- providing allocations for the 2023/24 school year to post-primary schools on 26 January, with those for primary schools issued on 31 January.

 

- providing for fully funded upskilling programmes in mathematics, physics and Spanish. Beginning with 170 places in January 2021, I have agreed to increase places to over 300 in 2023, and a new Irish upskilling programme is planned for 2023/24.

 

- providing for the allocation of a significant number of additional posts to primary substitute teacher supply panels in areas where significant challenges in sourcing substitution continue. This brings the total to 610 posts on 151 panels covering more than 2,840 schools.

These measures are underpinned by the Teaching Transforms campaign which promotes the teaching profession and encourages students to follow a career in teaching.

Despite the positive impact of these important actions, work remains to be done to address teacher supply challenges, particularly to ensure the availability of sufficient numbers of substitute teachers.

My Department continues to work intensively with all stakeholders to develop and implement creative solutions to address the teacher supply challenges for schools.

A Personal Public Service Number (PPS Number) is issued either automatically when a birth is registered or when a person applies for a PPS Number.

I can confirm that in 2021, my Department allocated 117,000 PPS Numbers and in 2022 that number increased to 249,000.  This is an increase of 132,000 or 113% over the 2021 figure.

My Department does not maintain records of instances where a person has applied for a PPS Number but is found not to be entitled to one or is found to already have a PPS Number.

As well as allocating PPS Numbers to those who arrive in the State, my Department also allocates PPS Numbers to people living abroad who need a PPS Number to transact with a public body, for example, for probate reasons, to pay stamp duty, etc. 

The total number of PPS Number applications on hand nationally is currently 14,300.  On average, it is now taking about one month to issue a PPSN on application.  Delays can occur where incomplete applications are submitted or there are problems with the quality of documents provided.  The processing of applications is kept under weekly review.  Where necessary, additional resources are allocated to address backlogs taking account of other work pressures.

An application from the person concerned was received on 24 January 2023.  In their application, the person applied only for the Free Television Licence element of the Household Benefits Package.  A Free Television Licence has been awarded and a letter issued to the person concerned on 26 January 2023. 

The person concerned did not apply for the Electricity or Gas Allowance on their application.  If this was an oversight and the person intended to have their entitlement to Electricity or Gas Allowance examined, they should contact my Department (providing a recent copy of their electricity or gas bill in their name) by email to householdbenefits@welfare.ie or in writing to Household Benefits Section, Department of Social Protection, College Road, Sligo, F91 T384.

State Pensions

The person concerned did not have sufficient contributions to qualify for the State Pension (contributory) which is based on the applicants own social insurance record.  The Widows Contributory Pension is currently in payment to them at the maximum weekly rate of €265.30 per week.  This is equivalent to the maximum rate State Pension (contributory).  The Widows Contributory Pension can remain in payment provided the governing conditions continue to be satisfied.  

In addition the person concerned may wish to apply for a Fuel Allowance.  This payment is a contribution towards the energy costs of a household.  The payment of €33 per week for 28 weeks (a total of €924 each year) is paid from late September to April to assist households with their energy costs.  To make an application, the quickest and easiest way to apply is online at mywelfare.ie.  Alternatively, if the person concerned is unable to access online services, an application form for Fuel Allowance has been issued to the person concerned and their entitlement can be examined when they submit the completed application to my department.  Only one Fuel Allowance is payable per household.

State pension non-contributory is a means-tested payment for people aged 66 and over, legally and habitually residing in the State, who do not qualify for a state pension contributory, or who only qualify for a reduced rate contributory pension based on their social insurance record.  For the purposes of the means-test, at application stage and through the lifetime of a claim, an applicant must provide full and up to date details of any income(s), asset(s), savings and investment(s) held and notify the Department of any relevant changes that may affect their pension entitlement.  

On 10 May 2022, a means review questionnaire issued to the person concerned.  On examination of the returned questionnaire and supporting financial documentation, the Deciding Officer determined that the person's weekly means had increased since the previous assessment and made a revised decision, reducing the weekly payment entitlement.  The person concerned was notified of this decision on 11 October 2022 and provided with details of the means assessment.  The letter also informed them of their right, if dissatisfied with the decision, to request a review, or to appeal the decision to the independent Social Welfare Appeals Office.  There is no record of an appeal having been lodged.

Maternity Leave

Maternity Benefit is a payment made to women who are on Maternity Leave from work or who are self-employed and who satisfy certain PRSI contribution conditions.

In cross-border situations, where a person lives in Northern Ireland and works here, or vice versa, it is  the State of employment that is responsible for maternity benefits.  So, in the situation to which the Deputy refers, where the person works here, they will qualify for Maternity Benefit paid by my Department, where they meet all of the usual qualifying conditions.

Maternity Benefit is paid for 26 weeks at a rate of €262 per week.  In 2023, it is estimated that my Department will spend approximately €273 million on the scheme.

Any proposal to extend the number of weeks for which Maternity Benefit is payable could only be considered in a Budgetary context.

An increase for qualified adult (IQA) is a means-tested payment, payable to a claimant whose spouse, civil partner or cohabitant is being wholly or mainly maintained by them, and where that qualified adult’s personal means from any source does not exceed a means test income limit.

Where a qualified adult has weekly means of less than €100, the maximum rate of IQA is payable.  Where their weekly means are over €100 and not more than €310, a tapering reduced rate of IQA is payable.  If the qualified adult has means of more than €310 per week, this exceeds the means limit and there is no entitlement to an IQA payment. 

As part of my Department’s commitment to ensuring that claimants are receiving their full and correct entitlements, ongoing reviews of all means tested payments are carried out.  The review is ongoing for the person concerned. Once the outstanding information is received in my Department, entitlement to the Increase for Qualified Adult allowance will be reviewed.

It is also open to the spouse of the person concerned to apply for State Pension (contributory) and/or State Pension non-contributory in their own right.  I have arranged for applications to issue.

The appointment of Special Advisers is subject to section 11 of the Public Service Management (PSMA) Act 1997 and the Guidelines for the 33rd Dáil, which incorporate the principles of section 11 of the PSMA Act.

The appointment of individual Special Advisers is a matter for each Government Minister subject to the terms set out in the aforementioned guidelines, although the appointments are also subject to formal Government approval.  At this stage, no Special Advisers have been formally appointed to my Department by the Government.  However, the Deputy may wish to note that I have assigned two Special Advisers to work with me; a Special Adviser on policy and a Press Adviser.  Said persons will be formally appointed by the Government following due process. 

The Minister for Public Expenditure and Reform must be notified of the rate of salary to be paid in all cases for Special Advisers.  These rates will then be published on the website of the Department of Public Expenditure and Reform.

Deputy Violet-Anne Wynne asked the Minister for Social Protection further to Parliamentary Question No. 489 of 18 October 2022, the total number of persons approved for domestic violence rent supplement in 2022; the number of those who were successful in securing accommodation, in tabular form; and if she will make a statement on the matter. Primary responsibility for the development and provision of services to support victims of domestic violence rests with the Department of Children, Equality, Disability, Integration and Youth.

The accommodation needs of victims of domestic violence are met through a joined-up service delivery model provided by Tusla with the close involvement of the various housing authorities nationwide.

Access to rent supplement can be provided on referral by Tusla or by prescribed Tusla funded service providers.  This provides victims of domestic violence with a fast track approval and screening process with a simplified means test  to get immediate access to rent supplement so that they are not prevented from leaving their home because of financial concerns.

The standard rent supplement means test does not apply to these applicants for an initial three month period.  After three months, a further three month extension may be provided, subject to the usual rent supplement means assessment.  After six months, if the tenant has a long-term housing need, they can apply to their local housing authority for social housing supports and, if eligible, will be able to access the Housing Assistance Payment, a social housing support provided by local authorities. 

While this protocol to assist victims of domestic violence in accessing rent supplement was initially introduced in August 2020 in response to the pandemic, I was pleased to announce in November 2021 that the measure has been made a permanent feature of the rent supplement scheme. 

Access to rent supplement is additional and complementary to the range of other supports already in place for victims of domestic violence.

In the period since August 2020, 266 victims of domestic violence have been supported with rent supplement under the protocol.  There are 23 victims of domestic violence currently being supported under the Protocol, with a further 36 victims of domestic violence being supported on rent supplement subject to the standard rent supplement means assessment and eligibility criteria, following a period of support under the domestic violence protocol.

Table 1 shows the number accessing rent supplement support under the domestic violence protocol at end of month for 2022.

The Fuel Allowance is a payment of €33 per week for 28 weeks (a total of €924 each year) from late September to April, at an estimated cost of €412 million in 2023.  The purpose of this payment is to assist these households with their energy costs.  Only one allowance is paid per household.

While Working Family Payment (WFP) is not a qualifying payment for fuel allowance, people may receive fuel allowance while on WFP if they have an entitlement based on their primary payment (e.g. One Parent Family Payment).

The estimated cost of extending the Fuel Allowance payment to all those in receipt of the Working Family Payment (WFP) is €23.2 Million.  This estimate is based on a weekly Fuel Allowance rate of €33 and a payment period of 28 weeks.

The person concerned was awarded State Pension (contributory) at 90% of the maximum rate from 11 December 2022.

A review of the contribution record of the person concerned is ongoing.  On receipt of the requested documentation, their entitlement to a higher rate of State Pension (contributory) will be examined.

My Department follows the mandatory procedures and methodology outlined in the Department of Public Expenditure and Reform Circular 01/2020, which states that, with effect from 1 January 2020, all Government Departments, Offices and Agencies are required to record, monitor, and value greenhouse gas emissions associated with official air travel and to make an annual payment to the statutory Climate Action Fund for these emissions for the preceding year.

A breakdown of the air travel data for 2020, 2021 and 2022 for my Department and the public bodies under its aegis is set out in tabular form below.

I can confirm that the Department has made annual payments as required to the Climate Action Fund in respect of 2020 and 2021 Air Travel.

The carbon tax rate for calculation of annual payments was determined as €26 per tonne of carbon in 2020 and €33.50 per tonne in 2021.  Confirmation of the 2022 carbon tax rate is awaited.  Upon receipt of this information from the Department of Environment, Climate and Communications, my Department will calculate the amount due and make the necessary payment for 2022 to the Climate Action Fund as mandated.

State Pension Non-Contributory (SPNC) is a means-tested payment for people aged 66 and over, habitually residing in the State, who do not qualify for a state pension contributory, or who only qualify for a reduced rate contributory pension based on their social insurance record.

State Pension (Contributory) (SPC) is a social insurance based payment made to people at age 66. This is not a means-tested payment. The State Pension (Contributory) is based solely on a person’s record of contributions. A person can receive payment of State Pension (Contributory) and continue to work or have other income such as an occupational pension.

Subject to a means test being satisfied, an increase for qualified adult on state pension contributory or non-contributory may be payable where a pension claimant’s spouse, civil partner or co-habitant is financially dependent on them.

With State Pension Contributory, an increase for qualified adult is a means-tested payment, payable to a claimant whose spouse, civil partner or cohabitant is being wholly or mainly maintained by them, and where that qualified adult’s personal means from any source does not exceed a means test income limit.

A person’s entitlement to a state pension non-contributory or to an increase for qualified adult on state pension contributory or non-contributory may, on review, be stopped or withdrawn if:

they are found to be financially better off on another payment (which has been awarded to them

the weekly statutory means limit is no longer satisfied

they no longer satisfy the Habitual Residence Condition (appropriate to State pension non-contributory, only)

they fail to disclose means when requested to do so

their whereabouts are not known when the Department tries to contact them

The age at which an individual becomes eligible for payment of SPC or SPNC is 66. According to annual population estimates released by the CSO, there were 381,292 females aged 66 or over in Ireland in 2022. This figure is provisional and subject to revision following the publication of the Census 2022 results.

The number of women in receipt of SPC and SPNC in each of the last 10 years is provided in Table 1.

Currently, there are 50,439 women Qualified Adults on a SPC claim, and 2,564 women Qualified Adults on a SPNC claim.

My Department does not hold data on the number of women who have had their payment stopped over the last 10 years. The number of claims rejected and disallowed for SPC and SPNC over each of the last 10 years is shown in Table 2. Due to the way data is stored in my Department, this data is only available in aggregated form. It is not possible to provide the breakdown by sex, or the breakdown of the reasons that a claim was rejected or withdrawn.

My Department has been and will continue to support the people affected by the explosion in Creeslough.  Emergency payments issued over the days immediately following the event related mainly to the purchase of items such as clothing and toiletries.  Further payments were made towards transport costs, replacement of items destroyed in the explosion and assistance with the purchase of items for new accommodation.

An official from my Department has been in contact with the family of the person concerned on a number of occasions including at the Dunfanaghy Intreo Centre. 

My Department has been advised that the family is currently living in fully furnished accommodation.

The person’s application is currently being considered under the Humanitarian Assistance Scheme.  The purpose of the Humanitarian Assistance Scheme is to provide income-tested financial support to people whose homes are damaged and who are not in a position to meet costs for essential needs.  A delay has arisen due to the complexity of this case.  However, I am advised that a decision will be made on this application shortly.

My Department is fully involved in the local response and continues to be available to support the people of Creeslough.

My Department provides a suite of income supports for those who are unable to work due to an illness or disability.  It is important to note that entitlement to these supports is generally not contingent on the nature of the illness or disability but on the extent to which a particular illness or disability impairs or restricts a person’s capacity to work.  Budgetary provision is not made in respect of any individual illness or disease. 

Illness Benefit is the primary income support payment for people who are unable to attend work due to illness of any type and who are covered by social insurance contributions.  It may be payable for up to two years, depending on satisfying the eligibility conditions. 

If a person does not qualify for Illness Benefit he or she may consider applying for Disability Allowance.  Disability Allowance is a means-tested scheme for people who have an injury, disease or physical or mental disability that has continued for at least one year, or is expected to continue for at least one year, and because of that disability they are substantially restricted in carrying out work that would be suitable for a person of the that age, experience and qualifications.  

Apart from these income supports, my Department also provides means tested supports under the Supplementary Welfare Allowance scheme for people who are ill but who do not qualify for Illness Benefit or Disability Allowance.  These payments help meet essential expenditure which a person could not reasonably be expected to meet out of their weekly income.

The payment is available to anyone who needs it and qualifies, whether the person is currently on a social welfare payment or in employment.  The payment amount will depend on a person’s weekly household income, their outgoings and the type of assistance needed.

My Department keeps the range of income supports under review in order to make sure they meet their objectives.  Any changes to the current system would need to be considered in an overall policy and budgetary context.

491. Deputy Pádraig O'Sullivan asked the Minister for Social Protection when a decision will made on a pension application by a person (details supplied); and if she will make a statement on the matter. [4304/23]

State pension (non-contributory) is a means-tested payment for people aged 66 and over, habitually residing in the State, who do not qualify for a state pension (contributory), or who only qualify for a reduced rate (contributory) pension based on their social insurance record.  For the purposes of the means-test, at initial application stage and throughout the lifetime of the pension claim, an applicant must provide full and up to date details of any income(s), asset(s), savings and investment(s) held, and notify the Department of any changes that may affect their pension entitlement.

An application for state pension (non-contributory) was received from the person concerned on 11 October 2022.  On 21 October 2022, the case was referred to a Social Welfare Inspector to investigate the means of the person, so that their pension entitlement could be assessed.  The Inspector has contacted the person regarding this investigation. 

The Inspector has been requested to expedite completion of the investigation.  On receipt of their report, a Deciding Officer will make a determination on their eligibility for state pension (non-contributory) and the person concerned will be notified of the outcome in writing.
