Ceist:

270. Deputy David Cullinane asked the Minister for Health the number of outstanding cases, both active and dormant, which were not otherwise resolved by settlement or withdrawal and relate to long-stay charges litigation; the date of the earliest outstanding case; and the date of the latest outstanding case. As indicated by the Attorney General in his report to the Government on this and other matters published on 7 February 2023:

- A total of 516 long stay and related legal cases were initiated over the period 2005 to 2013.

- 289 were in respect of private nursing home care with a further 37 in respect of a mix of public and private care.

- Although a number of the private cases have been settled, most of these cases have not been settled.

- The balance were in respect of public nursing home care but as the majority of these were instituted before the commencement of the Health Repayment Scheme they have since been resolved under the rubric of that scheme and the majority of the remainder have been settled.

- The remaining cases have been largely dormant.

Dáil statements relevant to the issues raised are scheduled for 9 February 2023.

The Department does not comment on individual litigation cases.
