Firstly, as the Deputy will be aware, the Health Service Executive is responsible for providing public health care in hospitals and communities throughout the country.

In that context I am sure you will understand that it is not possible for the Minister for Health to get involved in the care of any individual as my role relates primarily to legislation, national policy, overall budgetary allocation, corporate governance and public relations.

Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

From the correspondence you have sent I can see that the persons involved have already sent a formal complaint to HSE’s Your service Your Say, and I encourage them to continue to interact with the HSE directly.

If you or your constituent are not satisfied the timelines or the content of the response, please feel free to contact my Department again, through ministerial representation, and I will seek further clarification.
