asked the Minister for Education if he will state why a pension has not yet been paid to Mrs. Jane Tubridy, of St. McDara's Infant School, Carraroe, Galway, who retired from the service of the National Board on the 31st March, 1923, and whether he will take steps to see that a decision in this long outstanding case is expedited.

This is one of a number of cases in which the Department has been put to considerable trouble owing to the failure of teachers on retirement from the service to surrender possession of the teacher's residence, of which they had the use in their capacity as teachers. The residence in this case was provided by a State loan for the use of the teacher serving in the school for the time being, and the failure of Mrs. Tubridy to relinquish possession of the residence as from the date from which she ceased to give service in the school has, it is understood, put her successor in office to considerable inconvenience. Although Mrs. Tubridy has now surrendered possession of the residence, she has not given up possession of the whole of the land on which the residence was built, on the ground that she claims that she is the owner of portion of this land. The matter has been the subject of correspondence with the Congested Districts Board and has been under the consideration of the legal adviser of this Department, and, in view of the doubts that have arisen in regard to the title to the portion of the land in question, it has been decided to refer Mrs. Tubridy's claim for pension to the Teachers' Pension Office, without prejudice to any further action which it may be found necessary to take.
