CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CLAIM FOR COMMANDEERED MOTOR CAR.

asked the Minister for Defence if he is aware that a motor car, the property of Mr. MacMullin, Market St., Cootehill, Co. Cavan, was commandeered by National Troops on 28th August, 1922, and returned by them in a much damaged condition on 30th September, 1922; if he is aware that Mr. MacMullin has claimed £73 18s. 6d. compensation for same, being £40 18s. 6d. cost of repairs to car on its return and £33 for loss of business in consequence of the car being retained for 33 days; if £25 was offered by the Army Authorities in full settlement of claim, and if, in view of above, whether he will instruct that the claim be again inquired into and adequate compensation given.

The commandeering of Mr. MacMullin's car was necessitated by a collision between his car, which he was driving at the time, and a military car, which was put out of action. I understand that the mishap was due solely to Mr. MacMullin's furious and careless driving. His car was retained in military use for one month. On its return Mr. MacMullin signed a receipt stating that it was in the same condition as when commandeered. Otherwise the facts appear to be as stated by the Deputy. In all the circumstances I think that the award of £25 made was an equitable one.
