Vol. 21 No. 12

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - SALE OF KILDARE ESTATE.

asked the Minister for Fisheries if he is aware that the untenanted lands of Clonagh, Danielstown and Rathcoffey South, County Kildare, in the occupation of the executors of the late Mrs. Elizabeth Farrell, and formely part of Major Aylmer's estate, is to be sold by auction on November 16th, 1927, and can he say whether the Land Commission propose acquiring these lands for distribution.

The lands of Clonagh, Danielstown and Rathcoffey referred to comprise the holding of Mrs. Elizabeth Farrell, deceased, held by her as judicial tenant on the estate of Major John W. Aylmer, Co. Kildare. The estate is being dealt with by the Land Commission under the Land Act, 1923, and the holding will be retained under Section 23 (6) (a) on the appointed day, and the Commissioners will consider the advisability of exercising their powers of resumption under Section 29 of the Act. The Land Commission have no information as regards the proposed auction.

Mr. WOLFE

Arising out of that reply, will the Minister say whether this auction will in any way affect the right of the Land Commission to acquire this land?

The sale of the tenant's interest will not interfere in any way with the Land Commission's powers of resumption.
