CEISTEANNA—QUESTIONS. ORAL ANSWERS. - KINSALE COMPENSATION AWARD

asked the Minister for Finance if he is aware that a decree for £60 was granted under the Damage to Property (Compensation) Act to Michael Barry, victualler, Kinsale, but has not been paid, and if the Minister can see his way to reconsider his decision in this matter.

A report under Section 15 of the Act, not a decree, was made in this case recommending payment of £60 in respect of meat alleged to have been taken without the applicant's consent. It is the duty of my Department to examine recommendations of this kind, and after the fullest consideration of this case in the light of the information at my disposal, I was satisfied that the goods were not, in fact, taken without the applicant's consent. I accordingly felt bound to refuse payment, and I regret that I am unable to depart from this decision.

Is the Minister aware that in the same town and under the same circumstances some ten other merchants were paid for goods supplied to the Republican Army during their occupation of that town? Is the Minister aware that this man supplied goods in exactly the same manner as the others, and will he state why exactly he cannot reconsider his decision in view of the fact that these other people have been paid?

I am not aware that there are other cases in which the circumstances are the same.

If any further evidence is produced to the Minister to show that there were ten or twelve other merchants in the town who were paid for the goods they supplied under the same circumstances, will he reconsider the matter?

I will consider any evidence or information in connection with the case.
