CEISTEANNA—QUESTIONS. ORAL ANSWERS. - ALLEGED ATTEMPT TO SEARCH U.S.A. CITIZEN.

asked the Minister for Justice whether he is aware that it is alleged that Mr. John Mulhern (an American citizen) was held up and threatened with a gun and that an attempt was made to search him by a member of the C.I.D., at Carrick-on-Shannon, County Leitrim, on the 3rd May, 1928; whether this action was taken with the congnisance and approval of the police authorities; and if so, whether steps will be taken to ensure that this man will not be molested, threatened or assaulted while a visitor here.

I have had inquiries made, and I have ascertained that a detective officer had reason to believe that Mr. Mulhern was carrying a revolver in contravention of the Firearms Act, 1925. The detective officer exercised his powers under that Act and stopped and searched Mr. Mulhern. The detective officer did not produce any revolver and carried out his duty in a legitimate manner. If Mr. Mulhern complies with the law he will be subjected to no interference by the police.

Would the Minister say in what respect Mr. Mulhern did not comply with the law?

I have answered the Deputy's question.

You have not answered that part of it. Is every American citizen to be interfered with in the same way?

Any American citizen who comes to this country is subject to the laws of this country and must conduct himself in a proper fashion.

That is what Mr. Mulhern always has done. I asked the Minister in what manner Mr. Mulhern has misconducted himself?

I have already told the Deputy that Mr. Mulhern was searched for a revolver. He was asked if he had a revolver and he said "not at the present moment."

Is it usual for the C.I.D. to search every American citizen and tourist who comes into this country?

No, it is not usual.
