Ceisteanna—Questions. Oral Answers. - Lewis Estate (Co. Galway).

asked the Minister for Lands and Fisheries if he will state the reason why the Land Commission, in dealing with the congested estate of John A. Lewis, Esq., Co. Galway (Record S. 1990), excluded from the list of holdings retained for improvement and enlargement the holdings of fifty of the congested tenants on this estate.

Twenty-nine holdings were retained by the Land Commission on this estate under Section 28 (6) of the Land Act, 1923; of these 23 were retained for re-arrangement, and the remaining six were retained with a view to instituting proceedings for resumption. As regards the holdings referred to in the question as being excluded from the holdings retained for improvement and enlargement, the Land Commission did not consider it necessary to retain them, as the vesting of these holdings in the tenants will not prevent their being dealt with in connection with a scheme for the enlargement and improvement of holdings on the estate.

asked the Minister for Lands and Fisheries if he will state why the Land Commission, having bought the congested estate of John A. Lewis, Esq., County Galway (Record S. 1990), and having migrated the owner to another holding for the declared purpose of dividing all his estate amongst the congested tenants, have still left John A. Lewis, Esq., in the possession and occupation of an area of 117a. 3r. 36p. of arable land, situated in the townlands of Cuilleendaeagh and Garraunphaudeen, and for which area the Land Commission have paid Mr. Lewis the sum of £1,625 13s. 8d.

The lands referred to comprise two holdings occupied by J. A. Lewis as tenant on the Lewis estate, and have been retained by the Land Commission pursuant to the provisions of Section 28, Section 6 (d), sub-section 3 of the Land Act, 1923, and they have instituted proceedings with a view to obtaining an order from the Judicial Commissioner authorising them to resume the holdings.

asked the Minister for Lands and Fisheries if the Land Commission in dealing with the estate of John A. Lewis, Esq., County Galway (Record S. 1990), have yet instituted proceedings for the resumption of holding No. 57 (Dwyer's evicted holding), in which a tenancy is claimed by William J. Farren; and, if so, if he will state in what issue of the Iris Oifigiúil the notice of intention to do so was stated.

The Land Commission have retained the holding referred to, and have served notice on the tenant of their intention to apply for an order authorising them to resume the holding. The tenant has lodged an objection to such application being made, and his objection is pending for hearing before the Commissioners in Court. Notices of the intention of the Land Commission to apply for orders authorising the resumption of holdings are not published in Iris Oifigiúil.
