Ceisteanna—Questions. Oral Answers. - Tralee Old Age Pension Claimant.

asked the Minister for Local Government and Public Health if he will state why the old age pension has been refused to Michael McGuire, 22 Steepleview, Tralee; whether two old age pensioners, who have known the applicant for many years, have made sworn declarations that he is over 70 years; and whether the applicant has evidence regarding his age from school records; and whether he will state on what grounds the sworn declarations have not been accepted as conclusive evidence of age.

This claim was disallowed on appeal on the 3rd June, 1931. It was not clear on the evidence submitted that the claimant fulfilled the statutory qualification as to age. Solemn declarations as to age were received, as stated in the Deputy's question. A school record of the claimant's age was submitted which could not, however, be regarded as reliable. The declarations of themselves were not considered sufficiently relevant and conclusive to prove that the claimant had attained the statutory age for the receipt of a pension. They were merely statements of belief without adequate supporting reasons.
