Ceisteanna—Questions. Oral Answers. - Old Age Pension Prosecution.

asked the Minister for Finance if he is aware that there is much dissatisfaction in various parts of the country with the "estimate of means" of applicants for old age pensions arrived at by pension officers and if his attention has been drawn to a case heard at the Clare Circuit Court where an old age pensioner was prosecuted at the suit of the Minister for Finance for refund of overpayment of pension alleged to have been unlawfully received, and where the case was dismissed with costs.

The answer to the first part of the question is in the negative.

My attention has been called to a case heard recently in the Clare Circuit Court, where proceedings were instituted for the recovery of old age pension money overdrawn. The Circuit Court judge dismissed the civil bill on the merits, with costs, but in giving his decision stated that he considered that the case was a proper one for investigation.
