Vol. 97 No. 21

Ceisteanna—Questions. Oral Answers. - County Mayo Holding.

asked the Minister for Lands if he is aware that, on the instructions of the Land Commission, the sheriff collected the annuity due by Mrs. Margaret Garvey, Barnastang, Glenisland, Castlebar, County Mayo, in respect of her holding (Collection No. 127/5180) together with his costs; that the Land Commission cancelled Mrs. Garvey's rent receipts in October last and informed her that she was being issued with new rent receipts, which would include new turbary; that, since that time, she has received neither a rent receipt nor a six-day notice from the Land Commission to enable her to pay her rent; and, if so, if he will refund the costs incurred by Mrs. Garvey as a result of this oversight on the part of the Land Commission; and if he will take steps to avoid similar occurrences in the future.

I am not aware that there has been any oversight on the part of the Land Commission in the case in question. A temporary receivable order for the amount due to 1st December, 1944, was issued in the ordinary course to Mrs. Garvey; and, payment not having been made, a notice was issued on 2nd January, 1945, demanding payment within six days. Both the receivable order and the six-day notice were addressed to Mrs. Garvey at her address—Barnastang, Glenisland, Castlebar, County Mayo, and were not returned, undelivered, by the post office.

If this woman did not get these notices from the Land Commission, in view of the fact that the Land Commission had told her that they were issuing new receivable orders and that she has incurred these costs, will the Minister consider recouping her, as it is not her fault?

My information is that both the receivable order and the six days' notice were sent to her at her address and were not returned.

Whatever the Land Commission say, she did not get it.
